OPPOSITION: Seven people indicated their presence at the public heazing in opposition to the
proposal with five people speaking in opposition; and two petitions (containing
approximately 46 signatures) and one. photo album were submitted in opposition at the
public heazing.
REQUEST: Petitioner requests waiver of the following Code Sections under authority of Sections
18.12.060.030 and 18.12.060.110 to construct a new two-story duplex and retain an
existing single family dwelling on the subject property:
(a) SECTION 18.32.061.010 -
Minimum building site azea per dwelling unit.
(2.400 sq. ft. per unit required; 2.355 sq. ft.
proposed)
(b) SECTION 18.32.066.061 -
Vehicular accessway turning radius.
(Minimum 25 feet required; 24 feet proposed)
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim
Municipal Code Section 18.12.040, to decide. the above-referenced petition and public hearing having
been duly noticed for and held on the date set forthabove, I do hereby find:
1. That there are no special .circumstances applicable to the property such as size, shape,
topography, location or surroundings, which do not apply to .other identically zoned properties
in the vicinity because all the neighboring lots on the north side of Broadway have a similaz
shape and size with similaz frontages on both a public street and public alley;
2. That strict application of the Zoning code does not deprive the property of privileges enjoyed
by other properties in identical zoning classification in the vicinity because all the neighboring
lots on the north side of Broadway aze located in the same zone and aze developed with one
or two single-story dwellings (the proposal includes a duplex in a 2-story building) without
any zoning vaziances having been granted;

3. That approval of this multiple-family proposal would set an undesirable precedent because all
the neighboring lots on the north side of Broadway are developed with single family houses
(with second units in two instances) in contrast to the proposal for a duplex and a density
waiver; and
4. That approval of this 2-story proposal would have an adverse effect on the surrounding lower
density. single family neighborhood on the north side of Broadway because all the existing
residences on this block face are single-story and most are built in the "Craftsman" style.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has
reviewed the proposal for. waiver of minimum building site area per dwelling unit and minimum
vehiculaz accessway turning radius (driveway width), to construct a new 2-story duplex and retain an
existing single-family dwelling on arectangularly-shaped parcel of land consisting of approximately
0.16 acre, having a frontage of approximately 55 feet on the north side of Broadway, having a
maximum depth of approximately 133'h feet, being located approximately 143 feet east of the
centerline of West Street, and further described as 1015 West Broadway; and that the Planning
Director or his authorized representative has determined that the proposed project falls within the
definition of Categorical Exemptions, Class 5, as defined in the State of California Environmental
Impact Report (EIR) .Guidelines and is, therefore, categorically exempt from the requirement to
prepare an EIR.
Based on the evidence and testimony presented to me, I do hereby determine to DENY Variance No.
4183.
This decision is made, signed, and entered into the file this seventeenth day of June, 1992.

NOTICE: This decision shall become final unless an appeal to the City Council, in writing,
accompanied by an appeal fee, is filed with the City Clerk within 15 days of the date of the signing of
this decision or unless members of the City Council shall request to review this decision within said
