OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal,
and no correspondence in opposition was received.
REQUEST: Petitioner requests waiver of the following to establish a vocational training school
in an existing 26,100 sq.ft. industrial building:

Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim
Municipal Code Section 18.12.040, to decide the above-referenced petition and public hearing
having been duly noticed for .and held on the date set forth above, I do hereby find:
1. That there will be a maximum of 135 people on the premises during any given session; and
- that there will be 3 sessions per weekday: morning, afternoon, and evening;
2. That, based on R.O.P.'s past experience, approximately 30% to 35% of the students will
carpool or use public transit for transportation to and from this facility;
3. That the variance for this specific use (R.O.P.) will not cause an increase in traffic
congestion in the immediate vicinity nor adversely affect any adjoining land uses;
4. That a parking study, dated June 24, 1992 and submitted for this specific proposal to
substantiate the requested parking waiver, was approved by the City Traffic and
Transportation Manager;
5. That the granting of the variance under the conditions imposed will not be detrimental to
the peace, health, safety or general welfare of the citizens of the City of Anaheim;

6. That there are special circumstances applicable to the property such as size, shape,
topography, location or surroundings, which do not apply to other identically zoned
properties in the vicinity; and
7. That strict application of the Zoning code deprives the property of privileges enjoyed by
other properties in identical zoning classification in the vicinity.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has
reviewed the proposal for waiver of the minimum number of parking spaces to establish a
vocational training school in an existing 26,.100 sq.ft. industrial building on arectangularly-shaped
parcel of land consisting of approximately 2.02 acres having a frontage of approximately 254 feet
on the north side of Ball Road, having a maximum depth of approximately 328 feet, being located
approximately 667 feet west of the centerline of State Cottege Boulevard and further described as
.1617 East Ball Road; and does hereby approve the Negative Declaration upon finding that she has
considered the Negative Declaration together with any comments received during the public review
process and further finding on the basis of the initial study and any comments received that there
is no substantial evidence that the .project will have a significant effect on the environment.
Based on the evidence and testimony presented to me, 1 do hereby determine to approve Variance
No. 41.90, subject to the following conditions:
1. • That trash storage areas shall be provided and maintained in a location acceptable to the
Department of Maintenance and in accordance with approved plans on file with said
Department.
2. That a Plan Sheet for solid waste storage and collection and a Pfan for recycling shall be
submitted to the Department of Maintenance for review and approval.
3. That an on-site trash truck turn-around area shall be provided and maintained to the
satisfaction of the Department of Maintenance. Said turn-around area shall be specifically
shown on plans submitted for building permits.
4. • That plans shall be submitted to the City Traffic and Transportation Manager for his review
and approval showing conformance with the latest revisions of Engineering Standard Plan
Nos. 436 and 602 pertaining to parking standards and driveway locations. Subject
property shall thereupon be developed and maintained in conformance with said plans.
5. That all driveways shall be reconstructed to accommodate ten (10) foot radius curb returns
in conformance with Engineering Department Standard No. 137.
6. .That prior to issuance of a building .permit or within ninety 190) days from the date of
approval of this project, whichever occurs first, a traffic signal assessment fee equaling the
difference between the industrial and commercial assessment fees shall be paid to the City
of Anaheim in an amount as established by City Council Resolution.
7. That any one session at the subject facility shall be limited to a maximum of fifteen (15)
staff members and one hundred twenty (120) students as stated in the approved parking
study.

8. That subject property shall be developed substantially in accordance with plans and
specifications submitted to the City of Anaheim by the petitioner and which plans are on file with
the Planning Department marked Exhibit Nos. 1 through 3.
9. That prior to issuance of a building permit, or within a period of one (1) year from the date ofi
this decision, whichever occurs first, Condition Nos. 1, 2, 3 and 4, above-mentioned, shall be
complied with. Extensions for further time to complete said conditions may be granted in
accordance with Section 18.03.090 of the Anaheim Municipal Code.
10. That prior to final building and zoning inspections, Condition Nos. 5 and 8, above-mentioned,
shall be complied with.
11.* That approval of this application constitutes approval of the proposed request only to the extent
that k complies with the Anaheim Municipal Zoning Code and any other applicable City, State
and Federal regulations. Approval does not include any action or findings as to compliance or
approval of the request regarding any other applicable ordinance, regulation or requirement.
