REQUEST: Petitioner requests waiver of the following under authority of Code Section 18.12.060.060 to construct two 34 sq.ft. entry monument signs for an approved condominium complex. Section 18.32.067.030 - Permitted. identification signs in a residential zone. (one 20 sq,ft. sign permitted; two 34 sq ft. signs proposed) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18..12.040, to decide the above-referenced petition and public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the design of the proposed monument signs, located on-both sides of the Wilken Way entrance to subject residential development, is in scale with the design of the entrance because said driveway and proposed signs aze visually enclosed by high landscaped berms and 3-story buildings on both sides; and that, if said entrance driveway were. a public street, two signs would be permitted (one on each side); 2. That both monument signs will contain only the name of the residential development and, although the overall azea ofi each sign structure is 34 sq.ft., the actual size of the lettering is smaller; and that subject residential development consists of two tracts which, if both had frontage on a public street, would be permitted to have two signs; za4195.wp -page 1 - ZA 92-41 • 3. That there are special circumstances applicable to the property consisting of size, shape, location and surroundings, which da not apply to other identically zoned properties in the vicinity, because subject property is very lazge (consisting of over 9 acres developed with 170 dwelling units), that access to subject residential development is limited to Wilken Way (the sole public vehicle entrance/exit), that the amount of public street frontage is small relative to the project size (only 425 feet of frontage along Wilken Way fora 9+ acre site having total boundazies of over 2,000 feet); and 4. That strict application of the Zoning. code deprives the property of privileges enjoyed by other properties in identical zoning classification in the vicinity. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the .proposal for waiver of permitted identification signage to construct two 34 sq.ft. entry monument ,signs for an approved condominium complex on a rectangulazly-shaped parcel of land consisting of approximately 9.69 acres, having a frontage of approximately 425 feet on the south side of Wilken Way, having a maximum depth of approximately 590 feet, being located approxmately 610 feet east of the centerline of Harbor Boulevazd, and further described as 400 West Wilken Way (Summer Wind Condominium Complex); and that the Planning Director or his authorized representative has determined that the proposed project falls within the definition of Categorical Exemptions, Class 11, as defined in the State of California Environmental Impact Report (E1R) Guidelines and is, therefore, categorically exempt from the requirement to prepare an E1R. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 4195, subject to the following conditions: 1. That plans shall be submitted to the City Traffic and Transportation Manager for his review and approval showing conformance with Engineering Standazd No. 137 pertaining to sight distance visibility. 2. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans aze on file with the Planning Department marked Exhibit No. 1; provided, however, that, if both monument signs are removed, two (2) replacement signs may be incorporated into "retaining walls" on the existing landscaped berms located on both sides of the driveway, the maximum size of each sign to be equal to or smaller than one (1) display surface of the approved monument signs with the design, materials and colors being similaz to said monument signs. 3. That prior to issuance of a sign permit or within a period of one. (1) yeaz from the date of this decision, whichever occurs first, Condition Nos. 1 and 2, .above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 4. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations.
