REQUEST: Petitioner requests waiver of the following under. authority of Code Section 18.12.060.110 to construct 1,500 sq.ft. of administrative offices in an existing 57,344 sq.ft. warehouse complex: Sections 18.06.050.0212 - Minimum number of parking_spaces. 18.06.050.031 1 7 required; ~ proposed) 1 8 and 18.61.066.050 Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the proposal consists of about 1,500 sq.ft. of office space being added to about 3,140 sq.ft. of existing office space inside an industrial building totaling 57,345 sq.ft., and that the parking demand study prepared for this proposal (dated October 12, 1992) considered both existing and proposed office space, and there have been no problems to-date in connection with the ratio of existing office/warehouse uses; 2. That the parking demand study was reviewed and approved by the City Traffic and Transportation Manager; 3. That the request is minimal and will.not cause an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses; and za4208.wp -Page 1 of 4 - ZA 92-56 C] 4. That the granting of this variance under the conditions imposed will not be detrimental to the peace, health, safety or general welfare of the citizens of the City of Anaheim. CALIFORTTIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal for waiver. of minimum number of parking spaces to construct .1,500 sq.ft. of administrative offices in an existing 57,344 sgft. warehouse on a rectangularly-shaped .parcel of land consisting of approximately 2.8 acres located at the southeast comer of Orangewood Avenue and Dupont Drive, having approximate frontages of 362 feet on the south side of Orangewood Avenue and 295 feet on the east side of Dupont Drive and further described as 2220 :East .Orangewood Avenue; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received during-the public review process and further finding on the basis of the initial study and .any comments received that -there is no substantial evidence that the project will have a significant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 4208, subject to the following conditions: 1. That subject property shall be served with underground utilities in accordance with the latest City Electrical Rates, Rules and Regulations and the City's "underground policy." 2. That trash storage areas shall be provided and maintained in a location acceptable to the Department of Maintenance and in accordance with approved plans on file with said Department. Such information shall be specifically shown on the plans submitted for building .permits. 3. That a Plan Sheet for solid waste storage.. and collection, and a plan for recycling. shall be submitted to the Department of Maintenance for review and approval. 4. That an on site trash truck turn-around. area shall be provided and maintained to the satisfaction of the Department of Maintenance. Said tum: around area shall be specifically shown on plans submitted for building permits. 5. That certain driveways shall be reconstructed with ten (10) foot radius curb returns in conformance with Engineering Standard No. 137 and that certain existing driveways may be required to be removed and replaced with standard curb, gutter, .sidewalk and landscaping, as required by the City Traffic and Transportation Manager. 6. That existing street improvements (curb, gutter, sidewalk and/or drive approaches) shall be repaired, based upon an inspection and determination by a City field engineer. 7. That the appropriate traffic signal assessment fee shall be paid to the City. of Anaheim in an amount established by City Council Resolution. 8. That pursuant to Chapter 17.30 and 17.31 of Title 17 of the Anaheim Municipal Code, development fees for the Anaheim Stadium Business Center shall be paid to the City of Anaheim in an amount as determined by the City Council, ff determined by the City za4208.wp -Page 2 of 4 ~ - ZA 92-56 • • Traffic and Transportation Manager to be required. 9. That plans shall be submitted to the City Traffic and Transportation Manager for his review and approval showing compliance with the latest versions of Engineering Standard Plan Nos. 436 and 602 pertaining to parking standazds and driveway location. Subject property shall thereupon be developed and maintained in conformance with said plans. 10. That an on-site trash truck turn around azea shall be provided in compliance with Engineering Standard Detail No. 610 and as required by the Department of Maintenance. 11. That a plan shall be submitted showing the loading space for trucks, in compliance with Code Section 18.06.060. 12. That subject .property may be located in a special flood hazard zone designation (AO). If the proposed improvements exceed fifty percent (50%) of the building valuation ($1,804,184), flood proofing may be required. 13. That prior to commencement of the activity authorized under this resolution, or prior to the .time that a building permit is issued, or within a period of ninety (90) days ,from the date of this resolution, whichever occurs first, the legal owner(s) of subject property shall execute and record an unsubordinated covenant in a form approved by the City Attorney's Office wherein such owner(s) agree not to contest the formation of any assessment district(s) which may hereafter be formed pursuant to the provisions of Development Agreement No. 83-01 between the City of Anaheim and Anaheim Stadium Associates, which district(s) could include such legal .property owner's property. A copy of the recorded covenant shall then be submitted to the Zoning Division. 14. That. the legal. property owner shall irrevocably offer to dedicate to the City of Anaheim an easement fifty three (53) feet in width from the centerline of the street along Orangewood Avenue for street widening purposes. 15. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department mazked Exhibit No. 1. 16. That prior to issuance of a building permit or within a period of one (1) year from the date of this decision, whichever occurs first, Condition Nos. 2, 3, 4, 7, 8, 9, 11, 12 and 14, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 17. That prior to final building and zoning inspections, Condition Nos. 1, 5, 6, 10 and 15, above-mentioned shall be complied with. za4208.wp -Page 3 of 4 - ZA 92-56 ~ • 18. That approval of this application constitutes approval of the proposed request only to the extent. that it complies with .the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
