ZA 92-57 A DECISION OF THE ZONING ADMINISTRATOR APPROVING VARIANCE N0.4207 Categorically Exempt, Class 5 DATE OF PUBLIC HEARING: December 10, 1992 OWNER: ELSA REESE 2125 South Atlanta Street Anaheim, CA 92802 LOCATION: 2125 SOUTH ATLANTA STREET OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal, and no correspondence in opposition was received. REQUEST: Petitioner requests waiver of .the following under authority of Code Section 18.12.060.110 and 18.06.080 to retain an existing gazage conversion: .Sections 18.06.050.011 - Minimum number of required parking and 18.26.066.010 spaces. (2-car garage required; 2-car ca~ proposed) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040,. to decide the above-referenced petition and public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the parking variance will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses because more than 4 parking spaces .are available on-site in the long driveway in addition to 2 spaces in the proposed carport; 2. That the granting of the variance under the conditions imposed will not be detrimental to the peace, health, safety or general welfare of the citizens of the City of Anaheim; 3. That the petitioner's spokespersons testified at the public hearing that subject gazage conversion occurred between 20 to 30 years ago and that the petitioner purchased the property in 1976; and 4. That the petitioner's spokespersons were informed at the public hearing that the appropriate permits would have to be obtained from the Building Division .and that, if necessary, the conversion would have to be upgraded to comply with the applicable City Codes. za4207 wp -Page 1 of 3 - ZA 92-57 ~. Variance No. 4207 • CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal for waiver of the minimum number of pazking spaces to retain an existing converted gazage on an irregulazly-shaped parcel of land consisting of approximately 0.27 acre located at the northern terminus of Atlanta Street, having a frontage of approximately 49 feet on the north side of Atlanta Street, having a maximum depth of approximately 160 feet, being located approximately 180 feet north of the centerline of Lorane Way, and further described as 2125 South Atlanta Street; and that the Planning Director or his authorized representative has determined that the proposed project falls within the definition of Categorical Exemptions, Class 5, as defined in the State of California Environmental Impact Report (EIR) Guidelines and is, therefore, categorically exempt from the requirement to prepaze an EIR. Based on the evidence. and testimony presented to me, I do hereby determine to approve Variance No. 4207, subject to the following conditions: 1. That the petitioner shall obtain the appropriate permits (building, electrical, etc.) from .the Building Division for the converted.. garage. 2. That prior to issuance of a building permit or within a .period of one (1) yeaz from the date of this decision, whichever occurs first, Condition No. 1, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 3. That prior to final building andzoning inspections, subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim. by the petitioner and which plans are on file with the Planning Department mazked Exhibit No. 1. 4. That approval of this application constitutes approval of the. proposed request only to the. extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
