ZA 92-60 • A DECISION OF THE ZONING ADMINISTRATOR APPROVING VARIANCE N0. 4210 OWNER: McCULLAGH LEASING 276 East Palais Road, Anaheim, CA 92805 AGENT: SPECTRA SIGN CORPORATION 863 South Rose Place, Anaheim, CA 92805 LOCATION: 276 East Palais Road PUBLIC HEARING DATE: December 24, 1992 CEQA STATUS: Categorical Exemption, Class 11 OPPOSITION: No one indicated their presence at the public heazing in opposition to the proposal, and no correspondence in opposition was received. REQUEST: Petitioner requests waiver of the following under authority of Code Section 18.12.060.010 to permit a 36 sq.ft. freestanding monument sign: Sections 18.05.093.020.023 - Permitted location of freestanding_signns. 18.05.098 (40% of lot width j32 feet] required from and 18.61.067 north side property line; 5, ~ O [4 feet] proposed) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public heazing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the monument sign will be located so as not to interfere with vehiculaz and pedestrian lines-0f--sight to and from the public street, subject property and its driveway, and the adjacent properties and their driveways; 2. That there aze special circumstances applicable to subject industrial property consisting of size, shape and location, which do not apply to other identically-zoned properties in the vicinity because subject property is located on a cul-de-sac, it has a very small street frontage (80 feet) relative to its size (4.7 acres), and placing the sign at the required location (central 8 feet of the 80-foot frontage) would adversely impact placement of the 40-foot wide driveway to the property; and 3. That strict application of the Zoning Code deprives the property of privileges enjoyed by other properties in identical zoning classification in the vicinity because the other properties, although similaz in size, have significantly wider street frontages (200 feet and more). za.-4210.wp ZA 92-60 • VARIANCE N0. 4210 Page 2 of 3 CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has reviewed the proposal for waiver of permitted location of a freestanding sign to permit a 36 sq.ft. freestanding monument sign on an irregularly-shaped pazcel of land consisting of approximately 4.7 acres, having a frontage of approximately 80 feet on the south side of Palais Road, having a maximum. depth of approximately 555 feet, being located approximately 710 feet east of the centerline of Anaheim Boulevazd, and further described as 276 East Palais Road; and that the Planning Director or his authorized representative has determined that the proposed project falls within the definition of Categorical Exemptions, Class 11, as defined in the State of California Environmental Impact Report (EIR) Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. Based on the evidence and testimony presented to me, I do hereby determine to approve Vaziance No. 4210, subject to the following conditions: 1. That plans submitted for a sign permit shall be submitted to the City Traffic and Transportation Manager for review and approval, and shall show that the monument sign shall be located so as not to interfere with vehiculaz and pedestrian lines-of--sight to and from (a) the public street, (b) subject property and its driveway, and (c) the. adjacent properties and their driveways, as discussed in Sections 18.05.093.020.025 and 18.05.098 of the Anaheim Municipal Code. 2. ,That subject property shall be .developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans aze on file with the Planning Department mazked Exhibit Nos. 1 and 2; provided, however, that the specific sign location shall be shifted if required in connection with Condition No. 1, above. 3. That prior issuance of a sign permit or within a period of one (1) yeaz from the date of this decision, whichever occurs. first, Condition No. 1, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 4. That approval of this application constitutes approval of the, proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regazding any other applicable ordinance, regulation or requirement.
