OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal, and
no correspondence in opposition was received.
REQUEST: Petitioner requests waiver of the following to construct 16,105 sq.ft. of office azea inside
an existing industrial office/wazehouse facility:

Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.12.040, to decide the above-referenced petition and a public heazing having been duly
noticed for and held on the date set forth above, I do hereby find:
1. That a pazking demand letter dated November 18, 1992 was submitted by the petitioner to
substantiate the request for this specific proposal (144,950 sq.ft. of wazehousing, processing and
distribution uses [90%] and 16,105 sq.ft. of offices [10%]), and that said analysis was
determined to be adequate by the City Traffic and Transportation Ma~iager;
2. That the available parking for subject industrial building is legally nonconforming because it was
constructed under previous parking standazds (1 space/1,000 sq.ft. for warehousing uses and 2
spaces/1,000 sq.ft. for general industrial uses); that current standazds, adopted in 1982,
increased the requirement to 2.25 spaces/1,000 sq.ft. (thereby requiring 12'fi9b to 12590 more
pazking than before); and when modifications are made to such buildings, it is staff's practice to
base the parking requirement on current standazds;
3. That the variance will not cause an increase in traffic congestion in the immediate vicinity nor
adversely .affect any adjoining land uses; and

4. That the granting of the vaziance under the conditions imposed will not be detrimental to the
peace, health, safety or general welfaze of the citizens of the City of Anaheim.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has
reviewed the proposal for waiver of minimum number of pazking spaces to construct a 16,105 sq.ft.
office azea in an existing office/wazehouse facility on an irregulazly-shaped pazcel of land consisting of
approximately 8.09 acres, having a frontage of approximately 325 feet on the north side of Cerritos
Avenue, having a maximum depth of approximately 1,248 feet, being located approximately 600 feet
east of the centerline of Lewis Street, and further described as 1201 East Cerritos Street; and does
hereby approve the Negative Declazation upon finding that she has considered the Negative Declazation
together with any comments received during the public review process and further finding on the basis of
the initial study and any comments received that there is no substantial evidence that the project will have
a significant effect on the environment.
Based. on the evidence and testimony presented to me, I do hereby determine to approve Variance No.
4216, subject to the following conditions:
L That a traffic signal assessment fee equaling the difference between the industrial and commercial
assessmentfees shall be paid to the City of Anaheim in an amount as established by City
Council, and as determined by the City Traffic and Transportation Manager..
2. That plans shall be submitted to the City Traffic and Transportation Manager for his review and
approval showing conformance with the latest version of Engineering Standazd Plan Nos. 436
and 602 pertaining to parking standazds and driveway locations, and including that end stalls
shall beat least twelve (12) feet wide. Subject property shall thereupon be developed and
maintained in conformance with said approved plans.
3. That the driveway on Cerritos Avenue shall be reconstructed to a maximum width of thirty (30)
feet and to accommodate ten (10) foot radius curb returns, in conformance with Engineering
Department Standard No. 137.
4. That the legal property owner shall irrevocably offer to dedicate to the City of Anaheim an
easement fifty three (53) feet in width from the centerline of the street along Cerritos Avenue for
street widening purposes.
5. That a fee, in the amount of six hundred fifty dollars ($650) per one thousand (1,000) sq.ft. of
office space, shall be paid to the City of Anaheim for sewer capacity mitigation.
6. That the legal owner(s) of subject property shall execute and record an unsubordinated covenant
in a form approved by the City Attorney's Office wherein such owner agrees not to contest the
formation of any assessment district(s) which may hereafter may be formed for the purpose of
financing the undergrounding of utilities in the Anaheim Stadium Business Center.
7. That trash storage area(s) shall be provided and maintained in location(s) acceptable to the
Department of Maintenance and in accordance with approved plans on file with said Department.
Such information shall be specifically shown on the plans submitted for building permits.

8. That a Plan Sheet for solid waste storage and collection, and a plan for recycling shall be
submitted to the Department of Maintenance for review and approval.
9. .That an on-site trash truck turn-azound azea shall be provided and maintained to the satisfaction
of the Department of Maintenance. Said turn-azound azea shall be specifically shown on plans
submitted for building permits.
10. That subject property shall be developed substantially in accordance with plans and specifications
submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning
Department marked Exhibit Nos. 1 through 3.
11. That prior to issuance of a building permit or within a period of one (1) year from the date of
this decision, whichever occurs first, Condition Nos. 1, 2, 4, 5, 6, 7, 8 and 9, above-mentioned,
shall be complied with. Extensions for further time to complete said conditions may be granted
in accordance with Section 18.03.090 of the Anaheim Municipal Code.
12. That prior to final building and zoning inspections, Condition Nos. 3 and 10, above-mentioned,
shall be complied with.
13. That approval of this application constitutes approval of the proposed request only to the extent
that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State
and Federal regulations. Approval does not include any action or findings as to compliance or
approval of the request regazding any other applicable ordinance, regulation or requirement.
This decision is made, signed, and entered into the file this day fourteenth of January, 1993.

NOTICE: This decision shall become final unless an appeal to the City Council, in writing,
accompanied by an appeal fee, is filed with the City Clerk within 15 davs of the date after the signing of
this decision or unless members of the City Council request to review this decision within said 15 days.
