ZA 93-3 SAEED NABIEY 255 North Paseo Campo Anaheim, CA 92807 Attention: Ester Khobier/Nabiey RE: NOTICE OF DECISION - A decision of the Zoning Administrator approving Administrative Use Permit No. 92-06 (Large Family Day Caze Home) Notice is hereby given that the Zoning Administrator for the City of Anaheim has APPROVED the above referenced permit application for a lazge family day care home involving a maximum of twelve (12) children and located at 255 North Paseo Campo, Anaheim, California. This approval is based upon the following condition being satisfied: That the petitioner shall remove the carpeting in the garage and shall use said garage for parking purposes only, in compliance with the following sections of the Anaheim Municipal Code pertaining to "Large Family Day Care Home CY~iteria and Standards "and parking requirements for single family residences: (a) Section 18.04.140.030 -The use and dwelling unit shall comply with all site development standards of the underlying residential zone (RS 5,000 "Residential, Single Family ") in which it is located. (b) Sections 18.06.050.011 and 18.27.066 - For single family residentid uses, not less than two (2) parking spaces shall be provided in a garage. This condition shall be satisfied within a period of one (1) month after the date of this written decision (by February 14, 1993). Planning Department sta,,~`'may inspect the garage after that date to verify that the carpet has been removed and that the garage is being used for parking purposes, not for child day care activities. The authority and criteria for the approval of the large family day care home permit is in Section 1597.46 of the California Health and Safety Codes, and Section 18.04.140 of the Anaheim Municipal Code. According to Section 1597.46, the City shall issue anon-discretionary permit if. the large family day care standards set forth are met. These standards have been adopted by the City of Anaheim and aze set forth in Anaheim Municipal Code Sections 18.01.070 and 18.04.140. APPROVAL of this permit is based upon the following findings of fact: 1. That the public notice period ended on December 10, 1992. admu-06.wp -page 1 of 2 - ZA 93-3 200 South Anaheim Boulevard P.O. That this permit was agendized for the Zoning Administrator meeting of December 10, 1992 and continued to the meeting of January 7, 1993 for staff to inspect the premises and determine whether the gazage was being used for day care activities. 3. That Code Enforcement staff inspected the premises and took photographs showing that the 2- car garage was carpeted and was apparently being used for non parking purposes. 4. That the following opposition was submitted to the Planning Department: (a) One petition with six signatures (December 3, 1992); (b) One letter (December 3, 1992); and (c) Two telephone calls (December 3 and 7, 1992). 5. That four people were present at the January 10, 1992 meeting and three of them spoke in opposition with concerns regarding parking problems, pazents dropping off children and blocking residential driveways, too many children on the premises, and children inside the garage when the garage door is open. 6. That the use and building, as conditioned, comply with the applicable site development standards of the RS-5000(SC) "Residential, Single-Family -Scenic Corridor Overlay" Zone in which the property is located. 7. That the use complies with all of the criteria and standazds established for such use pursuant to Section 1597.46 of the California Health and Safety Codes and to the applicable provisions of .the Anaheim Municipal Code. Any person aggrieved by the decision of the Zoning Administrator may appeal such decision to the City Council, tendering the applicable appeal fee to the City Clerk's Office within twenty two (22) days following the date of this decision. Said permit shall not be deemed final, and permittee shall not be authorized to engage in the use granted by said permit, until the expiration of said twenty two day appeal period.
