APPROVING TENTATIVE PARCEL MAP NO. 92-252

LOCATION: An irregularly-shaped parcel consisting of about 3.4 acres having frontages on the
southeast corner of Santa Ana Street and Claudina Street, and the northwest corner of
Ellsworth Avenue and Olive Street.
OPPOSITION: -Two people indicated their presence in concern at the public hearing, and no
correspondence in opposition was received.
.REQUEST: Petitioner requests approval of Tentative Parcel Map No. 92-252 to create a three (3)
lot subdivision.
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim
Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing
having been duly noticed for and held on the date set forth above, I do hereby find:
1. That testimony presented at the public hearing noted that the site address shown on the
tentative parcel map (Exhibit 1) was incorrect (because it is the existing address of a nearby
lot) and should be deleted from the final parcel map, and that one of the dimensions in the
public notice was incorrect;
2. That the proposed map is consistent with the applicable General Plan;
3. That the design and/or improvement of the proposed subdivision is consistent with applicable
General Plan;
4. That the design of the subdivision or the proposed improvements are not likely to cause
substantial environmental damage or substantially and avoidably injure fish or wildlife or their
habitat;
5. That the design of the subdivision or the type of improvements is not likely to cause serious
public health problems; and
6. That the design of the subdivision or the type of improvements will not conflict with

easements, acquired by the public at large, for access through or use of property within the
proposed subdivision. '
CALIFORNIA ENVIRONMENTAL Qj,TALITY ACT FINDING: That the Zoning Administrator has
reviewed the proposal to create. a 3-lot subdivision on anirregularly-shaped parcel of land consisting
of approximately 3.4 acres having approximate frontages of 429 feet on the south side of Santa Ana
Street and 150 feet on the east side of Claudina Street (at the southeast corner of Santa Ana and
CIaudina streets), and 150 feet on the north side of Ellsworth Avenue and 153 feet on the -west side of
Olive Street (at the northwest corner of Ellsworth and Olive streets); and that the Planning Director or
his authorized representative has determined that the proposed project falls within the definition of
Categorical Exemptions, Class 15, as defined in the State of California Environmental Impact Report
(E1R) Guidelines and is, therefore, categorically exempt from the requirement to prepaze an EIR.
Based on the evidence and testimony presented to me, I do hereby determine to APPROVE Tentative
Parcel Map No. 92-252, subject to the following wnditions:
L That the landscaped setbacks along Ellsworth and Claudina streets shall be refurbished, and
that a landscape plan showing the specific plants and irrigation method shall be submitted to
the Planning Department for review and approval. The approved landscaping and irrigation
facilities shall be installed prior to approval of the final pazcel map.
Z. That a corner cut-off shall be dedicated to the City of Anaheim at the corner of Ellsworth
Avenue and Olive Street, and irrevocably offered for dedication at the corner of Santa Ana
Street and Claudina Street for street and public utility purposes and to accommodate a
sidewalk access ramp in conformance with Engineering Standard Detail No. 124. Said corner
cut-off shad be dedicated to the City on the final parcel map.
3. That the legal owner of subject property shall grant a public utility easement to the City of
Anaheim (for the Underground Conversion Program) to allow for installation of underground
padmounted facilities to serve the proposed and/or existing overhead and underground
services to each proposed parcel, as required by the Electrical Engineering Division of the
Utilities Department. Said easement shall be dedicated to the City on the final pazcel map.
4. That the legal owner of subject property shall dedicate to the City of Anaheim a public utility
easement along/across any existing overhead electrical pole lines crossing the parcels, as
required by the Electrical Engineering Division of the Utilities Department. Said easement
shall be dedicated to the City on the final parcel map.
5. That the final parcel map shall be corrected to delete any reference to a site address or street
address.
6. That subject property shall be developed substantially in accordance with plans and
specifications submitted to the City of Anaheim by the petitioner and which plans aze on file
with the Planning Department mazked Exhibit No. 1.

7. That prior to final parcel map approval, Condition Nos. 1, 2, 3, 4, 5 and 6, above-
mentioned, shall be complied with.
8. That approval of this application constitutes approval of the proposed request only to the
extent that it complies with the Anaheim Municipal Zoning Code and any other applicable
City, State and Federal regulations. Approval does not include any action or findings as to
compliance or approval of the request regazding any other applicable ordinance, regulation or
requirement.

NOTICE: This decision shall become final unless an appeal to the City Council, in writing,
accompanied by an appeal fee, is filed with the City Clerk within 10 davs of the date of the signing of
this decision or unless members of the City Council shall request to review this decision within said
15 days.
