LOCATION: 1401-1407 North Baxter Street
OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal, and
no correspondence in opposition was received.
REQUEST: Petitioner requests waiver of the following under the authority of Code Section
18.12.060.080 to establish a 4-parcel industrial subdivision:
Section 18.01.130 - Regpired street frontage.
(Lots required to have frontage on a public street or a11eX;
3-lots fronting on a private driveway proposed)
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.12.040, to decide the above-referenced petition and public hearing having been duly
noticed for and held on the date set forth above, I do hereby find:
1. That approval of this variance will not adversely impact vehicular circulation on subject property
or in the surrounding industrial area because a private driveway will be provided and maintained
for suitable public and emergency vehicular access to the proposed parcels;
2. That there are special circumstances applicable to the property consisting of its irregularly long
and narrow shape (630 feet long and maximum 98 feet wide) and location (wedged between a
residential area to the north and west, and a freeway to the south, and having access along only
49 feet of frontage on an industrial street), which do not apply to other identically zoned
properties in the vicinity; and
3. That strict application of the Zoning Code deprives the property of privileges enjoyed by other
properties in identical zoning classification in the vicinity.

VARIANCE NO. 4217
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has
reviewed .the proposal for waiver of required street frontage to permit a 4-lot industrial subdivision on an
irregularly-shaped parcel of land consisting of approximately 1.1 acres located at the southwest terminus
of Baxter Street, having a frontage of approximately 49 feet on the southwest side of Baxter Street,
having a maximum depth of approximately 630 feet and addressed as1401-1407 North Baxter Street; and
that the Planning Director or his authorized representative has determined that the proposed project falls
within the definition of Categorical Exemptions, Classes 5 and 15, as defined in the State of California
Environmental Impact Report (E1R) Guidelines and is, therefore, categorically exempt from the
requirement to prepare an E1R.
Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No.
4217, subject to the following conditions:
1. That subject property shall be developed substantially in accordance with plans and specifications
submitted to the City of Anaheim by the petitioner and which plans aze on file with the Planning
Department marked Revision No. 1 of Exhibit No. 1.
2. That prior to approval of Final Pazcel Map No. 92-258 or within a period of one (1) yeaz from
the date of this decision, whichever occurs first, Condition No. 1, above-mentioned, shall be
complied with.
3. That approval of this application constitutes approval of the proposed request only to the extent
that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State
and. Federal regulations. Approval does not include any action or findings as to compliance or
approval of the request regarding any other applicable ordinance, regulation or requirement.
This decision is made, signed, and entered into the file this eleventh day of February, 1993.

NOTICE: This decision shall become final unless an appeal to the City Council, in writing,
accompanied by an appeal fee, is filed with the City Clerk within 15 davs of the date of the signing of
this decision or unless members of the City Council shall request to review this decision within said 15
days.
