CEQA STATUS: Negative Declaration OPPOSITION: One person spoke in opposition at the January 7, 1993 public heazing, and no correspondence in opposition was received. REQUEST: Petitioner requests approval of a conditional use permit under authority of Code Sections 18.12.050.010 and 18.44.050.010 to permit on-sale beer and wine in an existing restaurant with waiver of the following under the authority of Code Sections 18.06.080 and 18.12.060.110: Sections 18.06.050.022 - 18.06.050.0231 and 18.44.066.050 Minimum number of parking spaces. (34 required; 27 proposed) Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced petition, pursuant to Anaheim Municipal Code Section 18.12.020, and a public heazing having been duly noticed for and held on the date set forth above, I do hereby find, pursuant to the Sections 18.02.030.030 through 18.02.030.035 of the Anaheim Municipal Code: 1. That the parking vaziance will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses, and that the City Traffic and Transportation Manager .has reviewed the proposal and concurs with the. proposed number of parking spaces for this specific. commercial center which consists of the following distribution of commercial uses: One enclosed restaurant 2,526 sq.ft. Three retail units 2.527 sq,ft. Total commercial center 5,053 sq.ft. 2. .That the granting of the pazking vaziance under the conditions imposed will not be detrimental to the peace, health, safety or general welfaze of the citizens of the City of Anaheim; za3578.wp - 1 - ZA 93-14 • • 3. That the proposed use is properly one for which a conditional use permit is authorized by the Zoning Code; 4. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which is proposed to be located; 5. That the size and shape of the site for the proposed use is adequate to allow the full development of the proposed use in a manner not detrimental to the particulaz azea nor to the peace, health, safety and general welfaze; 6. That the. traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area; and 7. That the granting of this conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfaze of the citizens of the City of Anaheim. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal to permit on-sale beer and wine in an existing restaurant with waiver of minimum number of pazking spaces on an rectangulazly-shaped parcel of land consisting of approximately 0.37 acre located at the northwest corner of Euclid Street and Beacon Avenue, having frontages of approximately 123 feet on the north side of Beacon Avenue and 132 feet on the west side of Euclid Street, and further described as 895 South Euclid Street; and does hereby approve the Negative Declazation upon finding that she has considered the Negative Declazation together with any comments received during the public review. process and further finding on the basis of the initial study and any comments received thaC there is no substantial evidence that the project will have a significant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to approve Conditional Use Permit No. 3578, subject to the following conditions: 1. That the trash enclosure gates shall be repainted and maintained in good condition. 2. That the parking lot shall be restriped to the satisfaction of the City Traffic and Transportation Manager. 3. That if this restaurant is issued an Alcoholic Beverage Control Department (A.B.C.) license, no entertainment shall be provided. 4. That if this restaurant is issued an A.B.C. license, the hours of operation shall be limited to 10:00 a.m. to 10:00 p.m. daily. 5. (a) That the applicant shall obtain a license from the Alcoholic Beverage Control Department (A.B.C.). (b) That the portion of this proposal consisting of the on premises sale and consumption of beer and wine shall be good for one (1) yeaz, after which time it shall be reviewed and, if the~applicant has not obtained a license from A.B.C., then the "on premises sale and consumption of beer and wine" in conjunction with a restaurant portion of subject proposal shall terminate. za3578.wp - 2 - ZA 93-14 • • 5. (c) That in the event A.B.C. does not issue a license, the pazking waiver portion of this conditional use permit shall continue in full force and effect in connection with subject 2,526 sq.ft. restaurant. 6. That plans shall be submitted to the City Traffic and Transportation Manager for his review and approval showing conformance with the Engineering Standazd No. 137 pertaining to sight distance visibility for the sign location. 7. That a seating plan with aisle dimensions and occupant load calculations shall be submitted to the Fire Department for review and approval. 8. That trash storage azeas shall be provided and maintained in a location acceptable to the Department of Maintenance and in accordance with approved plans on .file with said Department. Such information shall be specifically shown on the plans submitted for building permits. 9. That a plan sheet for solid waste storage and collection, and a plan for recycling shall be submitted to the Department of Maintenance for review and approval. 10. That an on-site trash truck turn-azound azea shall be provided and maintained to the satisfaction of the Department of Maintenance. Said turn-azound azea shall be specifically shown on plans submitted for building permits. 11. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 through 4. 12. That the on-premises sale of beer and wine shall take place only in conjunction with the serving of meals. 13. That prior to commencement of the activity herein approved (establishing a new restaurant, and on-sale beer and wine in connection with said restaurant), or prior to issuance of a building permit, or within a period of one (1) yeaz from the date of this decision, whichever occurs first, Condition Nos. 6, 7, 8, 9 and 10, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 14. That prior to commencement of the activity herein approved (establishing a new restaurant, and on-sale beer and wine in connection with said restaurant) or prior to final building and zoning inspections, whichever occurs fttst, Condition Nos. 1, 2, 5(a) and 11, above-mentioned, shall be complied with. 15. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations.
