APPROVING VARIANCE NO. 4213, IN PART

DATE OF PUBLIC HEARING: April 1, 1993, continued from the January 7, January 21,
February 4, February 18 and March 4 meetings.
OPPOSITION: No one indicated their presence at the public heazing in opposition to the proposal, and
no correspondence in opposition was received.
REQUEST: Petitioner requests waiver of the following to construct 4 additional wall signs for an
existing food market in a service station facility:
Sections 18.05.091.020 - Maximum number of wall signs.
18.12.060 1 si permitted on Food Mart building
and 18.84.062.040 in the Scenic Corridor;
3 signs proposed)
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.12.040, to decide the above-referenced petition and public hearing having been duly
noticed for and held on the date set forth above, I do hereby find:
That there are special circumstances applicable to the property consisting of its topography and
location which do not apply to other identically zoned properties in the vicinity because the
property is located at the top of a slope which makes visibility difficult from the adjacent rights-
of-way (Weir Canyon Road and the Riverside Freeway) and that subject facility is not located
adjacent to the highway (Santa Ana Canyon Road) from which it takes its sole access;
2. That strict application of the Zoning code deprives the property of privileges enjoyed by other
properties in identical zoning classification in the vicinity because visibility to the property is
restricted;
3. That the proposed signage was excessive but, because of the restricted visibility to the subject
businesses. (Shell service station, food mart and caz wash) the following signage (labeled on the
approved exhibits), which is small and is visible only when in close proximity to the subject
property, shall be permitted:

(1) Two (2) "A" signs consisting of the word "Shell" on the east and west facing
edges of the canopy, and
(2) Two (2) "B" signs consisting of the Shell "logo" on the east and west facing
edges of the canopy.
(b) Retain the following fifteen (15) signs on the three (3) spandrals connecting the gasoline
pumps in each island under the canopy:
(1} Six (6) "C" signs consisting of the word "Shell" on the north and south sides of
each spandral,
(2) Six (6) "D" signs consisting of the Shell "logo" on the north and south sides of
each spandral), and
(3) Three (3) "Q" signs consisting of the word "Self" on the west ends of each
spandral.
(c) Retain the following two (2} signs in connection with the car wash:
(1) One (1) "E" sign consisting of the words "car wash" on the south wall of the car
wash building, and
(2) One (1) "R" sign consisting of the words "car wash entrance" on a small sign
panel mounted on two short poles generally located on the north property line.
(d) Add two (2) new "H" wall signs to the food mart building consisting of the letters
"ETD" (meaning Experience The Difference).

3. (a) Retain the. following four (4) existing small signs on the canopy over the pump islands
and food mart building:
4. That all other signs, as listed below and labeled on the exhibits and including any signs which are
not otherwise herein approved, shall be removed within. a period of two (2) months from the date
of this decision and prior to installation of the new "ETD" signs, as stipulated to by the
petitioner at the public hearing:

All the pump. top signs which are specifically prohibited by Section 18.05.064.020 of the
Anaheim Municipal Code),
The "S" sign consisting of the words. "car wash <-" on small sign panel mounted on one
shortpole generally located on the east property line,
All the "F" wall signs consisting of the words "food mart" on at least two of the food
mart building walls,
All the "P" signs consisting of the "posters" mounted on the food mart building walls,
All the "W" signs consisting of any signs inside the window of the food mart building
(i.e., advertising "Marlboro"), and
Any other signs which have not been approved herein.

5. That the signage approved herein shall be the only signage permitted for the businesses located
on subject property.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has
reviewed the proposal for waiver of minimum number of walls signs to construct 4 wall signs for an
existing food market in connection with a service station and car wash located on anirregularly-shaped
parcel of land consisting of approximately 1.86 acres, having a frontage of approximately 261 feet on the
west side of Weir Canyon Road, having maximum depth of approximately 349 feet and being located
approximately 236 feet north of the centerline of Santa Ana Canyon Road and further described as 8275
East Santa Ana Canyon Road; and that the Planning Director or his authorized representative has
determined that the proposed project falls within the definition of Categorical Exemptions, Class 11, as
defined in the State of California Environmental Impact Report (ElR) Guidelines and is, therefore,
categorically exempt from the requirement to prepare an EIR.
Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No.
4213, in part, subject to the following conditions:
1. That the subject property shall be developed substantially in accordance with plans and
specifications submitted to the Ciry of Anaheim by the petitioner and which plans are on file with
the Planning Department marked Exhibit Nos. 1 and 2, and the photographs also contained in the
petition file; provided, however, that the maximum permitted signage for. subject facility shall be
as follows:
(a) Four (4) existing small signs on the canopy over the pump islands and food mart
building:
(1) Two (2) "A" signs consisting of the word "Shell" on the east and west facing
edges of the canopy, and
(2) Two (2) "B" signs consisting of the Shell "logo" on the east and west facing
edges of the canopy.
(b) Sixteen (16) signs on the three (3) spandrals connecting the gasoline pumps in each island
under the canopy:
(1) Six (6) "C" signs consisting of the word "Shell" on the north and south sides of
each spandral,
(2) Six (6) "D" signs consisting of the Shell "logo" on the north and south sides of
each spandral), and
(3) Three (3) "X" signs consisting of the word "Self' on the west ends of each
spandral.
(c) Two (2) signs in connection with the car wash:
(1) One (1) "E" sign consisting of the words "car wash" on the south wall of the car
wash building, and
(2) One (1) "R" sign consisting of the words "car wash entrance" on a small sign.

2. -That within a period of two (2) months from the date of this decision or prior to installation of
the new "H" signs on the food mart building, all of the following signs shall be removed:
(a) All the pump top signs,
(b) The "S" sign consisting of the words "car wash ~-" on small sign panel mounted on one
short pole generally located on the east property line,
(c) All the "F" wall signs consisting of the words "food mart" on at least two of the food
mart building walls,
(d) All the "P" signs consisting of the "posters" mounted on the food mart building walls,
and
(f) All the "W" signs consisting of any signs located inside the window of the food mart
building and facing outward (i.e., advertising "Mazlboro").
3. That no signage, other than what is herein approved, shall be permitted on subject property for
the Shell service station, car wash, food mart and/or any other uses that may be established.
(The two ,[2] off-site monument signs facing Santa Ana Canyon Road and the Riverside Freeway
shall nod be counted as part of the on-site signage).
4. That trash storageareas shall be provided and maintained in a location acceptable to the
Department of Maintenance and.. in accordance with approved plans on file with said Department.
Such information shall be specifically shown on any plans submitted for building permits.
5. That a plan sheet for solid waste storage and collection, and a plan for recycling shall be
submitted to the Department of Maintenance for review and approval in connection with any
plans submitted for building permit.
6. That within a period of two (2) months from the date of this decision (by June 8, 1993) or prior
to issuance of any sign permit or installation of any new approved sign, whichever occurs first,.
Condition No. 2, above-mentioned, shall be complied with. Extensions for further time to
complete said conditions maybe granted in accordance with Section 18.03.090 of the Anaheim
Municipal Code.
7. That approval of this application constitutes approval of the proposed request only to .the extent
that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State
and Federal regulations. Approval does not include any. action or findings as to compliance or
approval of the request regarding any other applicable ordinance, regulation or requirement.

This decision is made, signed, and entered into the file this eighth day April 1993.

NOTICE: - This decision shall become final unless an appeal to the City Council, in writing,
accompanied by an appeal fee, is filed with the City Clerk within 15 days of the date of the signing of
this decision or unless members of the Ciry Council shall request to review this decision within said
15 days.
