A DECISION OF THE ZONING ADMINISTRATOR
APPROVING VARIANCE NO. 4222

DATE OF PUBLIC HEARING: April 1, 1993
OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal, two
people spoke in favor of the proposal, and no correspondence in opposition was received.
REQUEST: Petitioner requests waiver of the following under authority of Code Section
18.12.060.010 to permit a second, 96 sq.ft. wall sign on the northeast building elevation
of a supermarket:
Sections 18.05.091.020 - Permitted number of wall suns.
and 18.84.062.040 (Maximum one wall sign per building unit
permitted in the Scenic Corridor; two proposed)
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.12.040, to decide the above-referenced petition and public hearing having been duly
noticed for and held on the date set forth above, I do hereby find:
That there are special circumstances applicable to the property consisting of its topography which
is below the grade of adjacent arterial highways thereby inhibiting visibility to the existing
supermarket wall sign, its size which is exceptionally large so that the supermarket is setback
more than 400 feet from the adjacent highways, its location which has frontage on two highways,
and the supermarket's surroundings which includes several buildings which block visibility from
the adjacent highways and freeway, and that these circumstances do not apply to other identically
zoned properties in the vicinity;
2. That strict application of the Zoning Code deprives the property of privileges enjoyed by other
properties in identical zoning classification in the vicinity because other businesses which are
located closer to the highways have adequate visibility to their business identification signs;
3. That the proposed wall sign is located on the northwest building wall which is opposite the wall
where the existing sign is located (southeast), that both wall signs will never be visible together
from any given location, that the proposed sign will primarily be visible only to on-ramp .traffic
entering the east-bound Riverside Freeway, that the northwest-facing supermarket wall exceeds
100 feet in length and that the over-all area of the proposed sign will cover less that 3 q of the
entire northwest-facing supermarket wall; and

4. That the proposed sign, reading "Albertons" with a logo, will consist of the letters and logo
being directly attached to the building wall, i~ot located on a panel which is then attached to the
wall.
CALIFORNIA .ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has
reviewed the proposed waiver of permitted number of walls signs to construct a 96 sq.ft. wall sign on
the northwest building elevation of Albertson's Supermarket located on anirregularly-shaped parcel of
land consisting of approximately 14.2 acres located at the northeast corner of Santa Ana Canyon Road
and Imperial Highway, having approximate. frontages of 1050 feet on the north side of Santa Ana
Canyon Road and 550 feet on the east side of Imperial Highway, and further described as 5757 East
Santa Ana Canyon Road; and that the Planning Director or his authorized representative has determined
that the proposed project falls within the definition of Categorical Exemptions, Class 11, as defined in
the State of California Environmental Impact Report (E1R) Guidelines and is, therefore, categorically
exempt from the requirement to prepare an EIR.
Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No.
4222, subject to the following conditions:
1. That subject property shall be developed substantially in accordance with plans and specifications
submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning
Department marked Exhibit Nos. 1 and 2.
2. That within a period of one (1) year from the date of this decision, Condition No. 1
above-mentioned, shall be complied with. Extensions for further time to complete said
conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal
Code.
3. That .approval of this application constitutes approval of the proposed request only to the extent
that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State
and Federal regulations. Approval does not include any action or findings as to compliance or
approval of the request regarding any other applicable ordinance, regulation or requirement.
This decision is made, signed, and entered into the file this eighth day of April 1993.

NOTICE: This decision shall become final unless an appeal to the .City Council, in writing,
accompanied by an appeal fee, is filed with the City Clerk within 15 davs of the date of the signing of
this decision or unless members of the Ciry Council shall request to review this decision within said 15
days.
