Resolution-ZA 1993-40r ~, ,~.:. • ! DECISION NO. ZA 93 - 40 A DECISION OF THE ZONING ADMINISTRATOR TERMINATING VARIANCE NO. 4168 OWNER: William C. Taormina and Cynthia Taormina 721 North Helena Street, Anaheim, CA 92805 AGENT: Arthur A. Helmstetter 415 South Chatham Circle, Unit F, Anaheim, CA 92806 LOCATION: 401 North Anaheim Boulevazd (Gina's Pizza) MEETING DATES: June 24, 1993, continued from the June 10 and May 27, 1993 Zoning Administrator meetings. REQUEST: Termination of Vaziance No. 4168 Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced request, I do hereby find: 1. That subject variance, approving waiver of the minimum number of parking spaces (49 spaces required; 1 on-site and 48 off-site spaces proposed) to establish a restaurant, was approved by the Zoning Administrator on January 23, 1992 and conditioned on a minimum of 48 off-site parking spaces being provided in connection with a parking agreement for the duration of the restaurant and that the restaurant use would terminate if the off-site parking spaces cease to be available (Condition No. 2 of Decision No. ZA92-8); 2. That Arthur A. Helmstetter (the original agent who obtained approval of this vaziance) submitted a letter, dated May 14, 1993, requesting termination of subject petition because the off-site pazking area required by Condition No. 2 of Decision No. ZA92-8 was no longer available; 3. That Code Enforcement staff inspected the off-site parking area and verified that it was no longer usable for parking purposes; 4. That, on June 10, 1993, William C. Taormina (owner of the property on which the restaurant is located as well as the property on which the off-site parking spaces were located) submitted a letter requesting termination of subject vaziance on the basis that the property on which the parking spaces were located is being sold; 5: That, on June 22, 1993, Mr. Helmstetter submitted a second letter indicating he no longer has a business interest in the restaurant; and b. That no one appeazed at the May 27, June 10 and June 24, 1993 Zoning Administrator meetings in opposition to the request.
