OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal and
no correspondence in opposition was received.
SUPPORT: One person spoke in favor of the project.
REQUEST: Waiver of the following under authority of Code Sections 18.06.080 and
18.12.060.110 to construct a 185,455 sq.ft. industrial building in two phases:
Sections 18.06.050.0212 - Minimum number of narking s aces.
18.06.050.031 448 required; 300 proposed)
and 18.61.066.050
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim
Municipal Code Section 18.12.040, to decide the above-referenced petition and public hearing having
been duly noticed for and held on the date set forth above, I do hereby find:
1. That a parking study for this specific proposal (a single tenant industrial use consisting of
manufacturing, warehousing and office space) was prepared by Barton-Ashman Associates,
Inc. and dated June 25, 1993; and that the City Traffic and Transportation Manager has
concurred with the conclusions of said study;
2. That the proposed use, as described by the petitioner, has very little general public contact
and the proposed parking is sufficient for employee parking;
3. That this parking variance will not cause an increase in traffic congestion in the immediate
vicinity nor adversely affect any adjoining land uses; and
4. That the granting of this variance under the conditions imposed will not be detrimental to the
peace, health, safety or general welfare of the citizens of the City of Anaheim.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Zoning Administrator has
reviewed the proposal for waiver of minimum number of parking spaces to construct a 185,455 sq.ft.
industrial building on anirregularly-shaped parcel of land consisting of approximately 9.5 acres,
having approximate frontages of 780 feet on the north side of La Palma Avenue and 740 feet on the

west side of Kellogg Drive, and further described as 5001 East La Palma Avenue; and does hereby
approve the Negative Declaration upon finding that she has considered the Negative Declaration
together with any comments received during the public review process and further finding on the
basis of the initial study and any comments received that there is no substantial evidence that the
project will have a significant effect on the environment.
Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No.
4234, subject to the following conditions:
1. That prior to issuance of a building permit, Lot Line Adjustment No. 308 shall have been
approved by the City Engineer and recorded in the Office of the Orange County Recorder.
2. That the developer shall comply with Chapter 14.60 of the Anaheim Municipal Code
pertaining to Transportation Demand Management (TDM).
3. That the developer shall pay a traffic and transportation improvement fee to the City Traffic
Engineering Division, in an amount established by the City Council resolution. The fee will
be used to fund traffic and transportation improvements within this area impacted by this
.project. Said fee shall be subject to adjustment by the City Council.
4. That all driveways shall be constructed with fifteen (15) feet radius curb returns as required
by the City Engineer in conformance with Engineering Standard No. 137.
5. That an on-site trash truck turn around area be provided in accordance with Engineering
Standard,Detail No. 610 and as required by the Department of Maintenance.
6. That a plan, showing that the loading space(s) for trucks conform with Code Section
18.06.060, shall be submitted to the Traffic Engineering Division for review and approval.
7. That the storage, use or dispensing of hazardous materials in quantities in excess of those
specified in Uniform Building Code Tables 9-A and 9-B shall comply with Uniform Fire
Code Article 80.
8. That fire hydrants shall be installed to comply with minimum Ciry Fire Department
requirements for spacing, distance to structure, and available fire flow.
9. .That subject property shall be developed substantially in accordance with plans and
specifications submitted to the Ciry of Anaheim by the petitioner and which plans are on file
with the Planning Department marked Exhibit Nos. 1 through 4.
10. That prior to issuance of a building permit or within a period of one (1) year from the. date of
this decision, whichever occurs first, Condition Nos. 1, 3, 5 and 6, above-mentioned, shall be
complied with. Extensions for further time to complete said conditions may be granted in
accordance with Section 18.03.090 of the Anaheim Municipal Code.
11. That prior to final building and zoning inspections, Condition Nos. 2, 4, 8 and 9,
above-mentioned, shall be complied with.

12. That approval of this application constitutes approval of the proposed request only to the
extent that it complies with the Anaheim Municipal Zoning Code and any other applicable
City, State and Federal regulations. Approval does not include any action or findings as to
compliance or approval of the request regarding any other applicable ordinance, regulation or
requirement.
