Box 2672 Grass Valley, CA 92945 AGENT: Universal Alloy Attention: John Ball 2871 La Mesa Avenue Anaheim, CA 92816 LOCATION: 2871 La Mesa Avenue CEQA STATUS: Negative Declaration HEARING DATE: October 14, 1993 OPPOSITION: No one indicated their presence at the public hearing in opposition and no correspondence in opposition was received; and that two people spoke in support of the proposal. REQUEST: Petitioner requests waiver of the following to construct a 32,200 sq.ft. expansion to an existing industrial building complex under authority of Code Section 18.12.060.110: Sections 18.06.050.0212 - Required number of rking spaces. 18.06.050.031 231 required by parking study; 18.06.080 430 required by Zoning Code; and 18.61.066.050 226 proposed) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the granting of the parking waiver will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses provided La Mesa Avenue is utilized for parking; 2. That the granting of the variance under the conditions imposed will not be detrimental to the peace, health, safety or general welfare of the citizens of the City of Anaheim; 3. That the proposed use of subject property should not require more than 231 parking spaces based upon the parking study as reviewd and approved by the Traffic and Transportation Manager; 4. That the primary use of the existing and proposed structures is a single tenant industrial warehouse which will not attract non-employee clientele to subject property. 5. That the total number of employees will be approximately 250 but that not all employees will be present on subject property at any one time due to the scheduling of employees in three shifts. za-V4236.wp - 1 of 3 - ZA 93-58 • CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal for waiver of minimum number of parking spaces to construct a 32,200 sq.ft. expansion to an existing industrial complex on an irregularly-shaped parcel of land consisting of approximately 7.96 acres, having approximate frontages of 676 feet on the south side of La Palma Avenue and 630 feet on the north side of La Mesa Avenue, being located approximately 180 feet east of the centerline of Blue Gum Street and further described as 2871 La Mesa Avenue; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a signfficant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 4236, subject to the following conditions: That a Lot Line Adjustment Plat shall be submitted to the Subdivision Section and approved by the City Engineer and then recorded in the Office of the Orange County Recorder to either (a) merge Parcels A and B of the Parcel Map recorded in Book 60, page 45, or (b) adjust the property lines such that the new building lies completely within one (1) parcel and meets the appropriated building fire wall standards. 2. That an automatic fire sprinMer system shall be designed, installed and maintained as required by the City Fire Department. 3. That the applicable traffic signal assessment fee shall be paid to the City of Anaheim in an amount established by City Council Resolution. 4. That the developer shall pay a traffic and transportation improvement fee to the City of Anaheim, Traffic Engineering Division, in an amount established by City Council resolution. This fee will be used to fund traffic and transportation improvements within the area impacted by this project. Said fee shall be subject to adjustment by the City Council. 5. That plans shalt be submitted to the City Traffic and Transportation Manager for his review and approval showing conformance with the current versions of Engineering Standard Nos. 436 and 602 pertaining to parking standards and driveway location. Subject property shall thereupon be developed and maintained in conformance with said plans. 6. That the developer shall comply with Chapter 14.60 'Transportation Demand" of the Anaheim Municipal Code relating to transportation demand management (TDM). 7. That trash storage areas shall be provided and maintained in a location acceptable to the Department of Maintenance and in accordance with approved plans on file with said Department. Such information shall be specifically shown on the plans submitted for building permits. 8. That a plan sheet for solid waste storage and collection, and a plan for recycling shall be submitted to the Department of Maintenance for review and approval. 9. That an on-site trash truck turn-around and/orflow-through area shall be provided and maintained to the satisfaction of the Department of Maintenance. Said turn-around orflow-through area shall be specifically shown on plans submitted for building permits. 10. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Panning Department marked F~chibit Nos. 1 and 2. za-V4236.wp - 2 of 3 - ZA 93-58 • 11. That, ff a building permit for the proposed expansion is not issued within a period of one (1) year from the date of this decision (that is, the permit is issued more than one [i ] year after the date of this decision), the petitioner shall, prior to issuance of said building permit, provide an updated parking study to the City Traffic and Transportation Manager for his review and approval. The parking study shall then be submitted to the Zoning Administrator for review as a Reports and Recommendation item. 12. That prior to issuance of a building permit or within a period of five (5) years from the date of this decision, whichever occurs first, Condition Nos. i, 3, 4, 5, 7, 8 and 9, above-mentioned, shall be complied .with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 13. That prior to final building and zoning inspections, Condition Nos. 2 and 10, above-mentioned, shall be complied with. 14. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
