Palmer LOCATION: 14.7 acres on the east side of Kraemer Boulevard between Miraloma Avenue and Coronado Street (includes 3130 and 3150 East Miraloma Avenuel CEQA STATUS: Categorical Exemption, Class 15 HEARING DATE: December 9, 1993 OPPOSITION: No one indicated their presence at the public hearing in opposition and no correspondence in opposition was received. REQUEST: Approval of a three-lot industrial subdivision Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.045, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the proposed parcel map is consistent with the applicable General Plan; 2. That the design and improvement of the proposed subdivision is consistent with the applicable Generai Plan; 3. That the design of the proposed subdivision and the proposed improvements are not likely to cause substantial environmental damage or to substantially and avoidably injure fish or wildlife or their habitat; 4. That the design of the proposed subdivision and the type of improvements are not likely to cause serious public health problems; and 5. That the design of the proposed subdivision and the type of improvements will not conflict with easements, acquired by the. public at large, for access through or use of property within the proposed subdivision. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal for a'3-lot subdivision, zoned ML "Industrial, Limited," on approximately 14.7 acres located on the TP93-207.wp - 1 of 3 - ZA 93-60 east side of Kraemer Boulevard between Miraloma Avenue and Coronado Street, having approximate frontages of 1,243 feet on the east side of Kraemer Boulevard, 772 feet on the south side of Miraloma Avenue and 200 feet on the north side of Coronado Street; and that the Planning Director or his authorized representative has determined that the proposed project falls within the definition of Categorical Exemptions, Classl5, as defined in the State of California Environmental Impact Report (EIR) Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative Parcel Map No. 93-207, subject to the following conditions: That street lighting facilities along Kraemer Boulevard and Miraloma Avenue shall be installed as required by the Utilities General Manager in accordance with specifications on file in the Office of the Utilities General Manager; or that security in the form of a bond, certificate of deposit, letter of credit,. or cash, in an amount and form satisfactory to the City of Anaheim, shall be posted with the City to guarantee the satisfactory completion of the above-mentioned improvements. Said security shall be posted with the City of Anaheim prior to final parcel map approval and the improvements shall be installed within four (4) .months. The requirement shall be noticed by an improvement certificate on the final parcel map. 2. That the legal owner of subject property shall dedicate to the City of Anaheim an easement as required by the Utilities Department for public utility purposes along the existing underground facilities serving Parcels 1-1 and 1-B (adjacent parcel addressed 3125 Coronado Street) and on Parcel 1-2. 3. That trash storage areas shall be provided for each parcel and maintained in a location acceptable to the Department of Maintenance, in accordance with approved plans on file with said Department. 4. That a plan sheet for solid waste storage and collection, and a plan for recycling for each parcel shall be submitted to the Department of Maintenance for review and approval. 5. That an on-site trash truck turn-around area shall be provided and maintained to the satisfaction of the Department of Maintenance for each parcel. Said turn-around area shall be specffically shown on plans submitted for building permits. 6. That sidewalks shall be constructed on Parcel 1-1 along Miraloma Avenue in accordance with standard plans and specifications on file in the Office of the City Engineer, and that the existing driveways shall be reconstructed with ten (10) foot radius curb returns as required by the City Engineer in conformance with Engineering Standard No. 137. A bond shall be posted and subdivision agreement executed prior to final parcel map approval for construction within four (4) months after map recordation. The requirement shall be noticed by an improvement certificate on the final parcel map. 7. That prior to issuance of a certificate of occupancy for any buildings on Parcels 1-2 and jor 1-3, sidewalks along Miraloma Avenue, Kraemer Boulevard and Coronado Street shall be constructed for said abutting parcel(s). The requirement shall be noticed by an improvement certifiicate on the final parcel map. 8. That the existing driveways near the intersection of Kraemer Boulevard and Miraloma Avenue shall be removed and replaced with standard curb, gutter, sidewalk and landscaping as required by the Public Works Department, Engineering Division. 9. That the two (2) southerly driveways on Kraemer Boulevard (approximately one hundred [160] feet south of Miraloma Avenue) shall be combined to one (1) driveway. TP93-207.wp - 2 of 3 - ZA 93-60 10. That all remaining and proposed driveways shall be constructed/reconstructed with ten (10) foot radius curb returns as required by the City Engineer in conformance with Engineering Standard No. 137. 11. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 and 2. 12. That the requirements specffied in Condition Nos. 3, 4, 5, 7, 9 and 10, above-mentioned, shall be noticed by an improvement certificate on the final parcel map, for completion in connection with the issuance of permits for buildings. 13. That prior to final parcel map approval or within a period of twenty four (24) months from the date of this decision, whichever occurs first, Condition Nos. 1, 2, 6, 8, 11 and 12, above-mentioned, shall be complied with. Time extensions maybe obtained in accordance with Section 17.08.110 of the Anaheim Municipal Code. This decision is made, signed, and entered into the file this 14th day of December 1993.
