OPPOSITION: Two concerned people indicated their presence at the public hearing and no
correspondence in opposition was received.
REQUEST: Petitioner requests approval of a conditional use permit under authority of Code Sections
18.12.050.040 and 18.44.050.270 to retain a private college with waiver of the following
under authority of Code Section 18.12.060.110:

Having been appointed Zoning Administrator by the Planning Director to decide the above-refierenced
petition, pursuant to Anaheim Municipal Code Section 18.12.020,. and a public hearing having been duly
noticed for and held on the date set forth above, I do hereby find, pursuant to the Sections 18.02.030.030
through 18.02.030.035 of the Anaheim Municipal Code:
That the requested parking waiver is substantiated by a parking study reviewed and approved by
the Traffic and Transportation Manager, showing that 18 parking spaces are adequate to serve the
subject private language college based on the current operations (teaching hours, and number of
students and employees) and the specific designation of office and classroom square footage.
2. -That the actual classroom size is only. i 230 square feet, and the number of on-site students and staff
members is limited at any single time.
2. That the parking variance will not cause an increase in traffic. congestion in the immediate vicinity
nor adversely affect any adjoining land uses; and
3. That the granting of this conditional use permit under the conditions imposed will not be detrimental
to the peace, health, safety and general welfare of the citizens of the City of Anaheim.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the
proposal to retain a private college on arectangularly-shaped parcel of land consisting of approximately 0.41
acre, having a frontage of approximately 80 feet on the north side of Lincoln Avenue, having a maximum
depth of approximately 226 feet, being located approximately 200 feet west of the centerline of Monterey
Drive and addressed at 2283 West Lincoln Avenue; and does hereby approve the Negative Declaration
upon finding that she has considered the Negative Declaration together with any comments received during
the public review process and further finding on the basis of the initial study and any comments received
that there is no substantial evidence that the project will have a significant effect on the environment.
Based on the evidence and testimony presented to me, I do hereby determine to approve Conditional Use
Permit No. 3660, subject to the following conditions:
1. That the hours of operation shall be limited to: 7 a.m. to 9 p.m. Monday to Friday only.
2. That the total number of students shall be limited to eighty (80) and the staff shall be limited to three
(3) full-time and (1) part-time employees.
3. That the use be limited to one thousand two hundred thirty (1,230) square feet of classroom space
and one thousand one hundred forty (1,140) square feet of office use.
4. That if subject use on this eighty (80) wide site is expanded in the future, the maximum number of
driveways may be limited to one (1), as required by the City Traffic and Transportation Manager.
5. That plans shall be submitted to the City Traffic and Transportation Manager for his review and
approval showing conformance with the current versions of Engineering Standard Plan Nos. 436
and 602 pertaining to parking standards and driveway locations. Subject property shall thereupon
be developed and maintained in conformance with said plans, including restriping of the parking
spaces.
6. That if subject use on this site is .expanded in the future, the single (new) driveway shall be
constructed/reconstructed with ten (10) foot radius curb returns as required by the City Engineer
in conformance with Engineering Standard No, 137.
7. That trash storage areas shall be provided and maintained in a location acceptable to the
Department of Maintenance and in accordance with approved plans on file with said Department.
Such information shall be specifically shown on the plans submitted for building permits.
8. That a plan sheet for solid waste storage and collection, and a plan for recycling shall be submitted
to the Department of Maintenance for review and approval
9. That an on-site trash truck turn-around area shall be provided in accordance with Engineering
Standard Detail No. 610 and maintained to the satisfaction of the Department of Maintenance. Said
turn-around area shall be specifically shown on plans submitted for building permits.
10. That subject property shall be developed substantially in accordance with plans and specifications
submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning
Department marked Exhibit Nos. 1 through 3.
11. That within a period of ninety (90) days from the date of this decision, Condition Nos. 5, 7, 8, 9 and
10, above-mentioned, shall be complied with. Extensions .for further time to complete said
conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code.

12. .That approval of this application constitutes approval of the proposed request only to the extent that
it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or approval
of the request regarding any other applicable ordinance, regulation or requirement.
This decision is made, signed, and entered into the file this 26th day of January 1994.
NOTICE: This decision shall become final unless an appeal to the City Council, in writing, accompanied by
an appeal fee, is filed with the City Clerk within 15 davs of the date of the signing of this decision or unless
members of the City Council shall request to review this decision within said 15 days.
