LOCATION: 48.5 acres located on all comers of the intersection of La Palma Avenue and Weir Canyon
Road, generally bounded on the south by the Santa Ana River and on the east by the City
of Yorba Linda, and having approximate frontages of 3,328 feet along La Palma Avenue
and 1300 feet along Weir Canyon Road. -
CEQA STATUS: Negative Declaration
HEARING DATE: March 31, 1994
OPPOSITION: No one indicated their presence at the public hearing in opposition and no
correspondence in opposition was received.
REQUEST: To create asix-lot subdivision.
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code
Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed
for and held on the date set forth above, I do hereby find:
1. That the proposed map is consistent with the applicable General Plan;
2. That the design or improvement of the proposed subdivision is consistent with the applicable
General Plan;
3. That the site is physically suitable for the type of development;
4. That the site is physically suitable for the proposed density of development;
5. That the design of the subdivision or the proposed improvements is not likely to cause substantial
environmental damage or substantially and avoidably injure fish or wildlife or their habitat;
6. That the design of the subdivision or the type of improvements is not likely to cause serious public
health problems; and

7. That the design of the subdivision or the type of improvements will not conflict with easements,
acquired by-,the public at large, for access through or use of property within the proposed
subdivision.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the
proposal for asix-lot subdivision on an irregularly-shaped parcel of land consisting of approximately 48.5
acres located on all corners of the intersection of La Palma Avenue and Weir Canyon Road, generally
bounded on the south by the Santa Ana River and on the east by the City of Yorba Linda, and having
approximate frontages of 3,328 feet along La Palma Avenue and 1300 feet along Weir Canyon Road; and
does hereby. approve the Negative Declaration upon finding that she has considered the Negative
Declaration together with any comments received during the public review process and further finding on
the basis of the initial study and any comments received that there is no substantial evidence that the project
will have a significant effect on the environment.
Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative Parcel
Map No. 85-159 subject to the following conditions:
1. That improvement certificates shall be placed on the face of the final map specifying that prior to
issuance of building or other development permits for each parcel of subject property, the
appropriate fees for primary water mains and secondary water mains shall be paid to the Water
Engineering Division, in accordance with Rules 15A and 20 of the Water Utility Rates, Rules and
Regulations.
2. That improvement certificates shall be placed on the face of the final map specifying that prior to
issuance of building or other development permits for. each .parcel of subject property having
:frontage ~lorag la` Palma Avenue, street lighting facilities along La Palma Avenue shall be ins*.alled-
_ as°required fythe Utilities General Manager in accordance with specifiratic~ns on file in the'Office
- ~ of the ~Jtilities>General Manager, or that security in the form of a bond, certifidate of deposit,: letter
of credit, ar cash; in an amount and form satisfactory to the City of Anaheim, shall be posted `wfth
the City ~ guarantee the satisfactory completion of the above-mentioned improvemerbt5: The
above-required improvements shall be installed prior to occupancy.
3. That all parcels within subject subdivision authorized by this decision shall. be served by
underground utilities.
4. That the legal owner of subject property shall irrevocably offer to dedicafe'to the City of Anaheim
on the final map an easement twenty (20) feet in width for water service. -mains and/or ten (10) x
twelve (12) foot easements for large meters or fire lines, as required by the Water Engineering
Division of the Utilities Department.
5. That an easement .shall be dedicated to the City of Anaheim to relocate the bicycle trail. Said
easement dedication shat{ be mutually agreed to by the City of Anaheim, the County of Orange and
the Anaheim Redevelopment Agency.
6. That the final map shall show all parcels to the centerlines of La Palma Avenue and Weir Canyon
Road, as required by the Subdivision Section of the Engineering Department.
7. That evidence consisting of a subdivision map and/or deed satisfactory to the Subdivision Section
of the Engineering Department shall be submitted showing that Yorba Regional Park is a legally
separate parcel(s) from proposed Parcel Nos. 5 and 6 which are owned by the County of Orange.
8. That prior to final parcel map approval, Condition Nos. 1, 2, 4, 5, 6 and 7, above-mentioned, shall
be complied with.

9. That approval of this application constitutes approval of the proposed request only to the extent that
it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or approval
of the request regarding any other applicable ordinance, regulation or requirement.

NOTICE: This decision shall become final unless an appeal to the City Council, in writing, accompanied by
an appeal fee, is filed with the City Clerk within 10 davs of the date of the signing of this decision or unless
members of the City Council shall request to review this decision within said 10 days.
