APPROVING VARIANCE NO. 4272

OPPOSITION: No one indicated .their presence at the public hearing in opposition and no
correspondence in opposition was received.
REQUEST: Petitioner requests of'the following to construct 18 open parking spaces (replacing
existing garages):
Sections 18.06.050.012.121 - .Minimum number of covered marking spaces.
and 18.34.066.010 ' (8 aarage spaces previously existing for twelve
2-bedroom apartments;
18 open spaces proposed)
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim. Municipal Code
Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed
for and held on the date set forth above, l do hereby find:
1. That the original garage parking spaces were constructed in conformance with Code requirements
in effect at the time of construction and are, therefore, legally nonconforming in terms of current
Code standards (2.25 spaces/unit for twelve 2-bedroom. apartment units =total 27 spaces = 24
covered spaces + 3 open spaces);
2. That on-site parking was previously at a ratio of 0.7 spaces per unit and the proposal more than
doubles the ratio to 1.5 spaces per unft;
3. That the open parking spaces are visually screened from the street by the rehabilitated apartment
buildings and from adjacent uses by 6-foot high fences;
4. That the granting of the variance will not cause an increase in traffic congestion in the immediate
vicinity nor adversely affect any adjoining land uses because the total number of apartment units
remains the same as originally;
5. That the granting of the variance under the conditions imposed will not be detrimental to the peace,
health, safety or general welfare of the citizens of the City of Anaheim because the number of off-
street parking spaces for the existing 12-unit apartment complex is being increased by 125% from
8 spaces to 18 spaces, thereby improving parking conditions in the neighborhood;

6. That there are special circumstances applicable to the property consisting of its size, location and
surroundings, which do not apply to other identically zoned properties in the vicinity because the
property is already developed and the upgrades, including the increased number of parking spaces,
are an notable improvement to the neighborhood; and that the upgrading of this apartment project
is a prototype for the entire neighborhood; and
7. That strict application of the Zoning Code deprives the property of privileges enjoyed by other
properties in identical .zoning classification in the vicinity because the parking at neighboring
apartments remains nonconforming with, typically, only 1off-street parking space per unit.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the
proposal for waiver of minimum number of covered parking spaces to permit 18 open parking spaces (to
replace 8 existing garages) on property consisting of approximately 0.85 acres, having a frontage of
approximately 247 feet on the west side of Citron Street, having a maximum depth of approximately 150 feet,
being located approximately 445 feet north of the centerline of La Palma Avenue, and further described as
11.05, 1107 and 1109 North Citron Street; and does hereby approve the Negative Declaration upon finding
that she has considered the Negative Declaration together with any comments received during the public
review process and further finding on the basis of the initial study and any comments received that there
is no substantial evidence that the project will have a significant effect on the environment.
Based on the evidence and testimony presented to me, I do hereby determine to approve
Variance No. 4272, subject to the following conditions:.
1. That subject property shall be developed substantially in accordance with plans and specifications
..submitted to the City of Anaheim by the. petitioner and which plans are on .file with the Planning
Department marked Exhibit No. 1 through 4.
2. That prior to final ..building and zoning :inspections or within a period of one. (1) year from the date
of this`decision, whichever occurs first, Condition No. 1, above-mentioned, shall be complied with.
Extensions forfurther time to complete said conditions.may be granted in accordance with Section
18.03.090 of the Anaheim Municipal Code.
3. That approval of this application constitutes approval of :the proposed request only to the extent that
it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or approval
of the request regarding any other applicable ordinance, regulation or requirement.
