OPPOSITION: No one indicated their presence at the public hearing in opposition and no
correspondence in opposition was received.
REQUEST: Approval of Tentative Parcel Map No. 95-179 to establish a 20-lot (plus 1 common lot)
industrial subdivision.
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code
Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed
for and held on the date set forth above, I- do hereby find:
1. That the proposed map is consistent with the applicable General and Specific Plans;
2. That the design and/or improvement of the proposed subdivision is consistent with applicable General
and Specific Plans;
3. That the design of the subdivision and/or the proposed improvements are not likely to cause
substantial environmental damage or substantially and avoidably injure fish or vvildNfe or their habitat;
4. That the design of the subdivision and/or the type of improvements are not likely to cause serious
public health problems; and
5. That the design of the subdivision and/or the type of improvements will not conflict with easements,
acquired by the public at large, for access through or use of the property within the proposed
subdivision.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the
proposal fora 20-lot,(plus i common lot) industrial subdivision on an approximately 5.56 acres, having a
frontage of approximately 395 feet on the north side of Hunter Avenue, with maximum depth of
approximately 650 feet and being located approximately 300 feet east of the centerline of Kellogg Drive; and
does hereby approve the Negative Declaration upon finding that she has considered.. the Negative
Declaration together with any comments received during the public review process and further finding on
the basis of the initial study and any comments received that there is no substantial evidence that the project
will have a significant effect on the environment.

Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative Parcel
Map No. 95-179, subject to the following conditions:
That an unsubordinated restricted covenant providing reciprocal access and parking, approved by
the City Traffic and Transportation Manager and Zoning Division and in a form satisfactory to the
City Attorney, shalt be recorded with-the Office of the Orange County Recorder. A copy of the
recorded covenant shall then be submitted to the Zoning Division. In addition, provisions shall be
made in the covenant to guarantee that the entire complex shall be managed and maintained as
one (1) integral parcel for purposes of parking, vehicular circulation, signage, maintenance,
landscaping, land usage and architectural control, and that the covenant shall be referenced in all
deeds transferring all or any part of the interest in the property.
2. That, if required by the Department of Maintenance, a plan sheet for solid waste storage and
collection and a plan for recycling shall be submitted to said department for review and approval.
3. That, if required by the Department of Maintenance, an on-site trash truck turn-around area shall be
provided and maintained to the satisfaction of said department. Said turn-around area shall be
specifically shown on any plans submitted to said department.
4. That, if required by the Public Works/Engineering Department, sidewalks shall be installed along
Hunter Avenue in accordance with Standard Detail 110 within ninety (90) days of final parcel map
recordation. Prior to final parcel map approval, a bond shall be posted with the Subdivision Section
to guarantee completion of said work:
5. That a maintenance covenant shall be submitted to the Subdivision Section and approved by the
City Attorney's Office.. The covenant shall include provisions for maintenance of private facilities and
a maintenance exhibit. The covenant shall be recorded concurrently with the final map.
6. That the legal property owner shall furnish a Subdivision Agreement, in a form approved by the City
Attorney, to the City of Anaheim agreeing to complete any public improvements that may be
required as conditions of subject map at the legal property owner's expense. Said agreement shaft
be submitted to and approved by the City of Anaheim and shall then be recorded concurrently with
the final parcel map.
That the petitioner shall submit a letter to the Zoning Division requesting termination of Variance No.
3831 (waiver of required public street frontage to establish a 20-lot, plus 1 common lot, industrial
subdivision).
8. That prior to final parcel map approval, Condition Nos. 1, 2, 3, 4, 5, 6 and 7, above-mentioned, shall
be complied with.
9. That approval of this application constitutes approval of the proposed request only to the extent that
it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or approval
of the request regarding any other applicable ordinance, regulation or requirement.

On January 18, 1996, Annika M. Santalahti, Zoning Administrator, considered your request for
Special Circumstances Waiver No. 96-01 to permit issuance of Special Event Permit(s) annually
for a business located in the ML (Limited Industrial) Zone for up to thirty (36) .days per calendar
year on property located at 125 East Ball Road, Anaheim. She made the following findings:
1. That the letter requesting this special circumstances waiver and describing the proposal was
submitted on December 13, 1995 by Peter 7. Hahm, General Manager/President, of
Anaheim .Yamaha Kawasaki;
2. That. approval of special circumstance waivers is authorized by Subsection 18.02.055.080
"Zoning Administrator Review (of Special Events Permits)" of the Anaheim Municipal
Code; and
3. That any modifications (to the standards established by the Section 18.02.055 "Special
Event Permit -General) approved in connection with this .special circumstances waiver, will
serve the public interest, safety and general welfare; and that an extraordinary circumstance
is present and consists of this being an industrially-zoned parcel in an azea of several
commercially zoned parcels, which parcels aze permitted, by right, to have special events
permits; and, further, that the underlying business is a commercial use, a motorcycle sales
and service dealership permitted in connection with Conditional Use Permit No. 3804);
Under authority of Sections 18.02.055.080 and Section 18.12.085, the Zoning Administrator
approved Special Circumstances Waiver No. 96-01, subject to compliance with the following
conditions:
1. That any special events permits shall be issued only in connection with the use established
under Conditional Use Permit No. 3804 (a motorcycle sales and service dealership in the
ML "Limited Industrial" Zone); .

2. That in the event Conditional Use Permit is terminated, subject special circumstance waiver
shall also terminate;
2. That special event permit(s) may be obtained annually for a maximum of thirty six (36) days
per calendar year; and
3. That any special event shall comply with all the standards and requirements set forth in
Section 18.02.055 Special Event Permit -General of the Anaheim Municipal Code except
as otherwise specifically provided herein, in compliance with Subsection 18.02.055.0606.
This decision shall become final unless an appeal to the Ciry Council, in writing, accompanied by
an appeal fee, is filed with the City Clerk within ten (10) days of the date of this letter or unless
members of the City Council request review of this decision within said 10 days.
