APPROVING TENTATIVE PARCEL MAP NO. 96-145

OPPOSITION: One person indicated her presence at the public hearing and spoke in opposition and no
correspondence in opposition was received.
REQUEST: To establish atwo-lot, RS-7,200 "Residential, Single-Family" subdivision.
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code
Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for
and held on the date set forth above, I do hereby find:
1. That subject property is vacant and conceptual plans were submitted showing that the proposed parcels
can be developed in conformance with the RS-7200 Zone standards, with the exception of the two
waivers (minimum lot width and minimum lot area) granted in connection with Variance No. 4294;
2. That the proposed subdivision, together with its design and improvements, is consistent with the
Anaheim General Plan;
3. That the design of the subdivision and the proposed improvements are not likely to cause substantial
environmental damage or substantially and avoidably injure fish or wildlife or their habitat because the
property is located in a fully developed area;
4. That the design of the subdivision and the type of improvements are not likely to cause serious public
health problems; and
5. That the design of the subdivision and the type of improvements will not conflict with easements,
acquired by the public at large, for access through or use of the property within the proposed
subdivision.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has
reviewed the proposal for waiver of minimum lot width and minimum lot area to establish atwo-lot, RS-7,200
caned subdivision on property consisting of approximately 0.39 acre located on the east side of East Street
approximately 100 feet south of the centerline of Wilhelmina Street and further described as 700 North East
Street; and does hereby approve the Negative Declaration upon fording that she has considered the Negative
Declaration together with any comments received during the public review process and further finding on the
basis of the initial study and any comments received that there is no substantial evidence that the project will
have a significant effect on the environment.

Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative Parcel Map
No. 96-145, subject to the following conditions:
1. That the legal property owner shall irrevocably offer to dedicate to the City of Anaheim an easement
forty five (45) feet in width from the centerline of the street along East Street oa the final parcel map.
2. That both of the subject parcels (Nos. 1 and 2) shall be addressed from East Street.
3. That an ingress/egress easement shall be reserved across Parcel No. 2 for the benefit of Parcel No. 1.
An agreement to provide the ingress/egress easement upon sale of either parcel, in a form satisfactory
to the Public Works Department and City Attorney, shall be recorded concurrently with the final parcel
map.
4. That recordation of the final parcel map is subject to approval of Variance No. 4294.
4. That prior to final parcel map approval, Conditions Nos. 1, 2, 3 and 4, above-mentioned, shall be
complied with.
5. That approval of this application constitutes approval of the proposed request only to the extent that it
complies with the Anaheim municipal Zoning Code and-any other applicable City, State and Federal
regulations. Approval does not include any action or findings as to compliance or approval of the
request regarding .any other applicable ordinance, regulation or requirement.

NOTICE: This decision shall become final unless an appeal to the City Council, in writing, accompanied by an
appeal fee, is filed with the City Clerk within 10 davs of the date of the signing of this decision or unless
members of the City Council shall request to review this decision within said 10 days.
