That the request is hereby granted in accordance with Subsection 18.12.080 of the Anaheim Municipal Code which permits maximum 20 % waivers of yard and setback requirements for all canes in connection with an administrative adjustment; and that the proposed twelve foot side yard is 209b less than required by Code in the RS-HS-43,000(5C) "Residential, Single-Family, Hillside-Scenic Corridor Overlay Zone (fifteen feet); and 2. That no written opposition was received during the required 10-day notification period which ended on September 25, 1996 at 5:00 p.m. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 114, subject to the following conditions: 1. That within a period of one (1) year from the date of this decision, subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1, 2, 3, 4 and 5. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 2. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Santalahti, Zoning Administrator, considered your request for Special Circumstances Waiver No. 96-10 to permit issuance of a Special Event Permit for two (2) banners to advertise a research project on property located at 1491 East La Palma Avenue. She made the following findings: 1. That a letter requesting this special circumstances waiver request and describing the proposal was submitted on August 29, 1996 by .Clark D. Danielson; and that the request was to permit two banners for an approximately one year period. 2. That the subject property is developed with a chiropractic health center in the CL "Commercial, Limited" zone. That approval of special circumstances waivers (allowing waiver of regulations pertaining to special events) is authorized by Subsection 18.02.055.080 "Zoning Administrator Review (of Special Events Permits)" and Section 18.12.085 "Special Event Permit -Review" of tbe Anaheim Municipal Code. 4. That the request is for waiver of the following standards established by the Section 18.02.055 "Special Event Permit -General," which permit special event permits for a maximum of thirty six (36) days per calendar year per business: Section 18.02.055.060.0607 - Maximum nine consecutive calendar days per special event; and Section 18.02.055.060.0608 - Maximum four special event permits per year. 5. That approval of this special circumstances waiver for an additional period of approximately two months serves the public interest and general welfare. Under authority of Sections 18.02.055.080 and Section 18.12.085, and as described in the petitioner's letter dated August 29, 1996 and the Staff Report dated October 10, 1996, the Zoning Administrator approved Special Circumstances Waiver No. 96-10 for the herein described special event, subject to compliance with the following conditions: . 1. That prior to re-installation of the banners, the petitioner shall obtain a Special Event Permit(s) from the Planning Department for the additional time period and shall pay the appropriate fees. 3. That this special event and any activities associated with it shall comply with all the standards and requirements set forth in Section 18.02.055 Special Event Permit -General of the Anaheim Municipal Code unless otherwise specifically provided herein. Santalahti, Zoning Administrator, considered your request for Special Circumstances Waiver No. 96-11 to permit issuance of a Special Event Permit for an outdoor carnival for the Loara Band Boosters on October 25 through October 28, 1996, on property located at 1440 South Anaheim Boulevard. She made the following findings: That a letter requesting this special circumstances waiver and describing the proposal was submitted on September 18, 1996 by John Schroeder, General Manager, and that there were no reported complaints for a similar event, held in October 1995. 2. That the subject property is developed with the Anaheim Indoor Marketplace in the CL "Commercial, Limited" zone. That approval of special circumstances waivers (allowing waiver of .regulations pertaining to special events) is authorized by Subsection 18.02.055.080 "Zoning Administrator Review (of Special Events Permits)" and Section 18.12.085 "Special Event Permit -Review" of the Anaheim Municipal Code. 4. That this request is for waiver of Section 18.02.055.060.0608 which permits a maximum of four (4) special event permits for a shopping center during a calendar year. 5. That approval of this special circumstances waiver, permitting a two day outdoor carnival, including a haunted house, over the October 26 and 27, 1996 weekend, serves the public interest and general welfare. Under authority of Sections 18.02.055.080 and Section 18.12.085, and as described in the petitioner's letter dated September 18, 1996 and the Staff Report dated October 10, 1996, the Zoning Administrator approved Special Circumstances Waiver No. 96-11 for the herein described special event on October 26 and October 27, 1996, subject to compliance with the following conditions: 1.
