REQUEST: To establish a 2-lot. RS-HS-22,000(SC) "Residential, Hillside, Single-Family -Scenic
Corridor Overlay" zoned subdivision
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly
noticed for and held on the date set forth above, I do hereby find:
1. .That the proposed. map is consistent with the applicable General Plan;
2. That the design and/or improvement of the proposed subdivision is consistent with the applicable
General Plan;
3. That the design of the subdivision or the proposed improvements are not likely to cause
substantial environmental damage or substantially and avoidably injure fish or wildlife or their
habitat;
4. That the design of the subdivision or the type of improvements are not likely to cause serious
public health problems; and
5. That the design of the subdivision or the type of unprovements will not conflict with easements,
acquired by the. public at Iarge, for access through or use of the property within the proposed
subdivision.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS:, That the Zoning Administrator has
reviewed the proposal fora 2-lot single-family subdivision on anirregularly-shaped parcel consisting of
approximately 1.09 acre, having a frontage of approximately 299 feet on the east side of Mohler Drive,
having a maximum depth of approximately 216 feet, and further described as 440 South Mohler Drive;
and that the Planning .Director or his authorized representative has determined that the proposed project
is Categorically Exempt, Class 15, of the ..California Environmental Quality Act (CEQA) Guidelines.

Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative Pazcel
Map No. 94-107, subject to the following conditions:
1. That prior to issuance of a building permit for proposed Parcel 2, the final parcel map shall be
submitted to and approved by the City of Anaheim and the Orange County Surveyor and then
recorded in the Office of the Orange County Recorder.
2. .That grading shall conform to all requirements of Chapter 17.06 "Grading, Excavations and Fills
in Hillside Areas" of the Anaheim Municipal Code. Said requirements include that a grading
plan, prepazed by a registered civil engineer, is required. for cumulative cut or fill exceeding one
hundred (100) cubic yazds.
3. That prior to issuance of a building permit for. proposed Parcel 2, the property shall be annexed
into County Sanitation District No. 2.
4. (a) That prior to issuance of a building permit for proposed Pazcel 2, street plans for the
proposed Parcels 1 and 2 shall be submitted to, and a bond posted with, the City of
Anaheim to guarantee that the street improvements on Mohler Drive shall be
constructed to conform to Public Works Department Standard No. 117. Said
. improvements shall be completed prior to final building and zoning inspection.
(b) That the requirements specified in pazagraph (a), above, shall be noticed by an
improvement certificate on the final parcel map.
5 That prior to fmal parcel map approval, proposed Pazce12 shall have an approved building
address. The property owner -shall submit an application and fee to the Building Division.
6. That the parcels shall be designated as Parcels 1 and 2 on the final pazcel map.
7. That prior to issuance of a building permit, unless proof of exemption is submitted in compliance
with City Council Resolution No. 89R-440, the appropriate Major Thoroughfare and Bridge Fee
shall be paid to the City of Anaheim in an amount as specified in the Major Thoroughfaze and
Bridge Fee Program for the Foothill/Eastern Transportation Corridor, as established by City
Council resolution.
8. That prior to issuance of a building permit, the applicable traffic signal assessment fee shall be
paid to the .City of Anaheim in an amount established by City Council resolution.
9. That prior to issuance of a building permit, the applicable fee shall be paid to the City of
Anaheim for Santa Ana Canyon Road widening purposes, in an amount as established by the
City Council.
10. That prior to issuance of a building permit, the developer shall pay a traffic and transportation
.improvement fee to the City of Anaheim, Traffic Engineering Division, in the amount established
by City Council resolution. This fee will be used to fund traffic and transportation
improvements within this azea impacted by this project. Said fee shall be subject to adjustment
by the City Council.
11. That prior to final parcel map approval, Condition Nos. 4(b), 5 and 6, above mentioned, shall

be complied with.
12. That prior to issuance of a building permit, Conditions Nos. 3, 4(a), 7, 8, 9 and 10, above-
. mentioned, shall be complied with: These conditions are informational and for the benefit of the
developer. This is not an inclusive list of requirements or fees that may be charged when plans
are submitted and a building permit is issued.
13. That approval of this application constitutes approval of the proposed request only to the extent
that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State
and Federal regulations. Approval does not include any action or findings as to compliance or
approval of the request regarding any other applicable ordinance, regulation or requirement.
