Categorical Exemption -Class 15 HEARING DATE: January 2, 1997 OPPOSITION: No one indicated their presence at the public hearing in opposition and no correspondence in opposition was received. REQUEST: To establish a 2-lot industrial subdivision. Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That the proposed map is consistent with the applicable General Plan; 2. That the design and/or improvement of the proposed subdivision is consistent with the applicable General Plan; 3. That the design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage. or substantially and avoidably injure fish or wildlife or their habitat; 4. That the design of the subdivision and the type of improvements are not likely to cause serious public health problems; 5. That the design of the subdivision and the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of the property within the proposed subdivision; 6. That each parcel contains parking that exceeds Code requirements for the existing buildings and uses; and 7. That, as conditioned, the parcel map will comply with applicable City Codes. CALIFORNIA ENVIRONMENTAL UALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal for 2-lot ML "Limited Industrial" zone subdivision on arectangularly-shaped parcel consisting of approximately 6.1 acres located at the southwest corner of Winston Road and State College Boulevard, having frontages of approximately 438 feet on the south side of Winston Road and 548 feet on the west side of State College Boulevard, and further described as 1363 South State College Boulevard; and that the Planning Director or his authorized representative has determined that the proposed project is Categorically Exempt, Class 15, under the State of California Environmental Quality Act Guidelines. Tl'96-173.wp - 1 of 2 - ZA 97-01 • Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative Parcel Map No. 96-173, subject to the following conditions: 1. That the five (S~ existing doors in the west wall of the larger building shall be replaced with 3/4 hour fire rated metal doors and frames with automatic door closures, as required by applicable City Codes and the Building Division. 2. That the two (2) existing windows in the west wall of the larger building shall be replaced with a 3/4 hour fire rated glazing or that 3/4 hour interior fire shutters shall be placed above these two (2) windows with fusible links and hard wired to the alarm system, as required by applicable City Codes and the Building Division. 3. That the existing concrete tilt-up wall shall be brought up to current Fire and Building Code requirements. 4. That the existing fence enclosure shall be removed or provided with "panic" hardware on all gates. S. That the overhead canopies in the court yard between the two (2) buildings shall be removed. 6. That trash storage areas for each parcel shall be provided and maintained in locations acceptable to the Department of Maintenance and in accordance with approved plans on file with said departments, 7. That a plan sheet for solid waste, collection and a plan for recycling for each parcel shall be submitted to the Department of Maintenance for review. 8. That an on-site trash turn-around shall be provided and maintained to the satisfaction of the Department of Maintenance. Said turn-around shall be specifically shown on plans submitted to the Department of Maintenance. 9. That an unsubordinated restricted covenant providing reciprocal access and parking, approved by the City Traffic and Transportation Manager and the Zoning Division and in a form satisfactory to the City Attorney, shall be recorded with the Office of the Orange County Recorder. A copy of the recorded covenant shall then be submitted to the Zoning Division. In addition, provisions shall be made in the covenant to guarantee that We entire complex shall be managed and maintained as one (1) integral parcel for purposes of parking, vehicular circulation, signage, maintenance, land usage and architectural control, and that the covenant shall be referenced in ail deeds transferring all or any part of the interest in the property. 10. That prior to final parcel map approval Condition Nos. 1 through 9, above mentioned, shall be complied with.
