REQUEST: Petitioner requests waiver of the following to construct a 355 sq.ft. addition to an existing gift shop in conjunction with, and accessory to, an existing hotel complex: Sections 18.12.060.050 - _Minimum interior structural setback and_..yard and 18.48.070.090.0903 requirements. 10 feet required; none proposed along south property line) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section i 8.12.040, to decide the above-referenced petition and a public hearing having been duty noticed for and held on the date set forth above, I do hereby find: i. That there are special circumstances applicable to the property consisting of its lot size and shape, which is exceptionally long and narrow (60i feet by 85 feet), which do not apply to other identically zoned properties in the vicinity; 2. That strict application of the Zoning Code deprives the property of privileges enjoyed by other properties in identical "zoning classification in the vicinity because the adjacent property to the south is developed with a 0 setback to an approximately 40 foot high building along the shared property line; 3. That the proposed addition is consistent with, and in alignment with, an existing building which has a 0 setback along the south property line; and 4. That the petitioner testified at the public hearing that the adjacent business owner has given them permission to enhance the north wall of the adjacent building as shown on Exhibit No. 6, a computer- enhanced photograph showing landscaped trellises attached to the north wall of said adjacent building. ZA-V4300.wp -1 of2- ZA 97-2 i CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal for waiver of minimum interior structural setback and yard requirements on a rectangularly-shaped parcel consisting of approximately 1.20 acres, with a frontage of approximately 85 feet on the east side of Harbor Boulevard, a depth of approximately 60i feet, being located approximately 1,220 feet north of the centerline of Freedman Way and further described as 1530 South harbor Boulevard (Carousel Inn and Suites); and that the Planning Director. or his authorized representative has determined that the proposed project is Categorically Exempt, Class 5, under the State of California Environmental Quality Act Guidelines. Based on the evidence and testimony presented to me, I do hereby approve Variance No. 4300, subject to the following conditions: 1. That no banners, paper orpainted-on window signage advertising products or services shall be placed in or on the windows of the existing anti expanded gift shop. 2. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on fife with the Planning Department marked Exhibit Nos. 1 through 6. 3. That prior to the issuance of a building permit or within a period of one (1) year from the date of this decision, whichever occurs first, Condition No. 2, above-mentioned, shalt be complied with. Extensions for further time to complete said condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipa! Code. 4. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
