OPPOSITION: No one indicated their presence at the public hearing in opposition and no
correspondence in opposition was received.
REQUEST: Petitioner requests waiver of the following to construct a 105 sq.ft. addition to an
existing single-family residence:
Section 18.26.063.010 - Minimum front yard structural setback.
25 feet required; 20 fee proposed)
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim
Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing
having been duly noticed for and held on the date set forth above, I do hereby find:
1. That there are special circumstances applicable to the property consisting of its shape
(trapezoidal) and location (on a cul-de sac), which do not apply to other identically zoned
properties in the vicinity; and
2. That strict application of the Zoning Code deprives the property of privileges enjoyed by
other properties under identical zoning classification in the vicinity because other nearby
homes have front setbacks which aze less than 25 feet; and that the waiver is minimal,
consisting of a setback which is only 5 feet less than required by Code.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator
has reviewed the proposal for waiver of minimum front yard structural setback on an irregulazly-
shaped parcel consisting of approximately 7,405.. sq.ft., having a frontage of approximately 79 feet on
the south side of Damon Avenue, having a maximum. depth of approximately 107 feet, being located
approximately 460 feet west of the centerline of Pythias Avenue, and further described as 1461 West
Damon Avenue; and that the Planning Director or his authorized representative has determined that
the proposed is Categorically Exempt, Class 1, under the State of California Environmental Quality
Act Guidelines.

Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No.
4305, subject to the following conditions:
That subject property shall be developed substantially in accordance with plans and
specifications submitted to the City of Anaheim by the petitioner and which plans are on file
with the Planning Department mazked Exhibit No. 1.
2. That prior to the issuance of a building permit or within a period of one (1) year from the
date of this decision, whichever occurs first, Condition No. 1, above-mentioned, shall be
.complied with. Extensions for further time to complete said condition may be granted in
accordance with Section 18.03.090 of the Anaheim Municipal Code.
3. That approval of this application constitutes approval of the proposed request only to the
extent that it complies with -the Anaheim Municipal Zoning Code and any other applicable
City, State and Federal regulations. Approval does not include any action or findings as to
compliance or approval of the request regarding any other applicable ordinance, regulation or
requirement.
