OPPOSITION: No one-indicatedaheir presence at the.public-hearing in opposition and no
correspondence. in opposition was received.
REQUEST: Petitioner proposes. waiver of the following to construct a 398 sq.ft. room addition to
an existing 1,680 sq.ft. single-family residence:
Sections 18.12.060.070 - Maximum lot coverage.
and 18.27.062:030 - ~ permitted; '40.7% proposed)
Having been appointed Zoning Administrator by the Planning Director,. pursuant to Anaheim Municipal
Code Section 18.12.040, to decide he above-referenced petition and a public hearing having been duly
noticed for and held on the date set forth above, i do hereby #ind:
That the request is minimal and there are special circumstances applicable to the property
consisting of its location and surroundings, which do not apply to other identically zoned
properties in thevicinitybecause the' proposed rear yard setback, which is four times greater
than Code requires, will serve as a buffer for this addition to the residences to the east;
2. That strict application of the Zoning Code deprives the property of privileges enjoyed by other
properties under identical zoning classification in he vicinity because waivers have been
approved in the RS-5000 zone. for similar lot coverage proposals; and
3. That a second floor addition of the same size is permitted without a variance and that a ground
floor addition is more architecturagy compatible vrith the surrounding neighborhood; and that,
other than lot coverage, the proposal .complies with Code requirements.
Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No.
4310, subject to the following conditions:.
1. That subject property shall be developed substantially in accordance with plans and
specifications submitted to She City of Anaheim. by the petitioner and which plans are on file with
the Planning Department marked Exhibit No. 1.

2. That prior to final building and zoning inspections or within a period of one (1) year from the
date of this decision, whichever occurs first, Condition No. 1, above-mentioned, shall be
complied with. Extensions for further time to complete said conditions may be granted in
accordance with Section 18.03.090 of the Anaheim Municipal -Code.
3. That approval of this application constitutes approval of the proposed request only to the extent
that it complies with the Anaheim Municipal Zoning Code-and any other applicable City, State
and Federal regulations. Approval does not include any action or findings as to compliance or
approval of the request regarding any: other applicable ordinance, regulation or requirement.
This decision is made, signed, and entered into the file this 7th day of August, 1997.
