APPROVING VARIANCE NO. 4325

OPPOSITION: No one indicated their presence at the public hearing in opposition and no
correspondence in opposition was received.
REQUEST: Petitioner requests waivers of the following to construct a new 1,916 sq.ft. single-
family residence:
(a) Sections 18.12.060.070 - Maximum lot coverage.
and 18.26.062.030. 40% permitted; 43% proposed)
(b) Sections 18.12.060.050 Minimum front yard setback.
and 18.26.063.010. 25 feet required from ultimate right-of--way along
La Palma Avenue; 10 feet .proposed)
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim
Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing
having been duly noticed for and held on the date set forth above, I do hereby find:.
1. That the proposed residence will be constructed in connection with an existing 430 sq.ft.
detached- garage;
2. That waiver (a) is minimal, amounting to a lot coverage which is only 3 % more than
permitted by Code;
3. That there are special circumstances applicable to the property consisting of its size and
dimensions, which do not apply to ,other identically zoned properties in the vicinity, because
the existing lot is only 3,915 sq.ft. in size (54% of 7,200 sq.ft., the Code minimum) and only
45 feet wide (64% of 70 feet, the Code minimum); and
4. That waiver (b) is hereby approved on the basis that strict application of the Zoning Code
deprives the property of privileges enjoyed by other properties in identical. zoning
classification in the vicinity because existing residential lots along La Palma Avenue have
similar front setbacks, as measured from the ultimate right-of--way along La Palma Avenue;
and that the existing lot size and width. are nonconforming.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator
has reviewed the proposal for waivers of maximum lot coverage and minimum front yard setback to
construct a 1,916 sq.ft. single-family residence on a 0.14-acre rectangularly shaped lot located at the
northwest corner of La Palma Avenue and Lark Street, ,having frontages of 45 feet on the north side
of La Palma Avenue and 87 feet on the west side of Lark Street, and further described as 1247 East
La Palma Avenue; and that the Planning Director or his authorized representative has determined that
the proposed project is Categorically Exempt, Class 3, under the State of California Environmental
Quality Act Guidelines.
Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No.
4325, subject to the following conditions:
1. That the existing garage shall comply with the minimum standards of the City of Anaheim,
including the Uniform Building, Plumbing, Electrical, Mechanical, and Fire Codes as adopted
by the City of Anaheim.
2. That subject. property shall be developed substantially in accordance with plans and
specifications submitted to the City of Anaheim by the petitioner and which plans are on file
with the Planning Department marked Exhibit Nos. 1 and 2.
That prior to final building and zoning inspections or within a period of one (1) year from the
date of this decision, whichever occurs first, Condition Nos. 1 and 2, above-mentioned, shall
be complied with. Extensions for further time to complete said conditions may be granted in
accordance with Section 18.03A90 of the Anaheim Municipal; Code.
4. That approval of this application constitutes approval of the proposed request only to the
extent that it complies with the Anaheim Municipal Zoning Code and any other applicable
City, State and. Federal regulations. Approval does not include any action or findings as to
compliance or approval of the request regarding any other applicable ordinance, regulation or
requirement.

accompanied by an appeal fee, is filed with the City Clerk within 1515 davs of the date of the signing of
this decision or unless members of the City Council shall request to review this decision within said
