ZA 98-04 A DECISION OF THE ZONING ADMINISTRATOR FOR CONDITIONAL USE PERMIT N0.3981 BE DENIED OWNER: John PeDicini 350 East 17th Street, #116 Costa Mesa, CA 92663 AGENT: Francisco and Flora Flores 1755 West La Palma Avenue Anaheim, CA 92801 LOCATION: 1753 West La Palma Avenue CEQA STATUS: Negative Declaration HEARING DATE: February 12, 1998 OPPOSITION: That one person submitted a letter opposing the proposal and appeared in opposition at .the December 18, 1997 public hearing. REQUEST: Petitioner requests approval of a conditional use permit under authority of Code Sections 18.12.050.010 and 18.44.050.010 to permit on-premises sale and consumption of beer and wine in a restaurant and accessory amusement arcade devices. Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced petition, pursuant to Anaheim Municipal Code Section 18.12.020, and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find, pursuant to the Sections 18.02.030.030 through 18.02.030.035 of the Anaheim Municipal Code: 1. That this proposal does not include an amusement arcade because only four amusement devices are proposed and an "amusement device arcade" is defined as containing five or more devices; 2. That the request is hereby denied on the basis that the crime rate in the reporting district in which the proposal is located is 116% above average for the City of Anaheim; and that the Police Department, therefore, recommended denial; 3. That the proposed use is properly one for which a conditional use permit is authorized by the Zoning Code; 4. That the proposed use will adversely affect the, adjoining land uses and the growth and development of the area in which it is proposed to be located because of the surrounding area's high crime rate; 5. That the size and shape of the site for the proposed use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare because no waivers would be necessary if this proposal were approved; and za-c3981.doc -1 of 2 - ZA 98-04 \ ___ ,,~:~-w. • 6. That granting. of this conditional use permit would be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim because the crime rate for the surrounding area is higher than the average for the City; CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal to perrniYon-premises sale and consumption of beer and wine and an accessory amusement arcade in a restaurant with on a 0.37-acre rectangularly-shaped property having a frontage of 125 feet on the north side of La Palma Avenue, a maximum depth of 130 feet and being located 645 feet west of the centerline of Euclid Street (1753 West La Palma Avenue); and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received during the public review process and .further finding on the basis of the. initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to deny Conditional Use Permit No. 3981. This decision is made, signed, and entered into the file this 19th day of February, 1998. Anni a M.
