OPPOSITION: No one indicated their presence at the public hearing in opposition and no
correspondence in opposition was received.
SUPPORT: One person was present and spoke in support of the proposal, and one petition signed
by the neighbors in support of this proposal was received.
REQUEST: Petitioner requests waiver of the following to construct a 7,000 sq.ft. single-family residence
(adding 2,500 sq.ft. to existing 4,500 sq.ft.):
(a) Sections 18.12.060.040 - Maximum structural height.
18.23.062.0201 25 feet permitted in the Scenic Corridor Zone Overlay;
and 18.84.042.010 36 feet proposed)
(b) Section 18.12.060.050
and 18.23.063.030
Reguired rear yard setback.
(minimum 25 feet required; 15 feet proposed)
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly
noticed for and held on the date set forth above, I do hereby find:
1. That waiver (a), maximum structural height, is hereby approved based on the irregular sloping
topography of this property; and that the strict application of the Code would prevent the
property owner from enjoying a 2-story single-.family residence similar to other homes in the
neighborhood.
2. That waiver (b), minimum rear yard setback, is hereby approved based on the irregularly-shaped
site that creates an angled rear yard and affects placement of a covered porch in the rear yard;
that overall the average rear yard setback will exceed 55 feet; and that the proposed covered
porch will not affect any adjacent property.
3. That strict application of the Zoning Code deprives the property of privileges enjoyed by other
properties in identical zoning classification in the vicinity.
4. That the petitioner testified he spoke with all the neighbors within a 300-foot radius of his
property and they indicated their support of this proposal

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has
reviewed the waivers of maximum structural height and required rear yard setback to construct an
approximately 7,000 sq.ft. (existing 4,500 sq.ft. and 2,500 sq.ft. addition) single-family residence on
0.59-acre, irregularly-shaped property having frontage of 22 feet on the east side of Owens Drive, having
a maximum depth of 189 feet and being located 900 feet north of the centerline of Mohler Drive (230
South Owens Drive); and that the Planning Director or his authorized representative has determined that
the proposed project is Categorically Exempt, Class 1, of the State of California Environmental Quality
Act Guidelines.
Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No.
4336, subject to the following conditions:
1. That subject property shall be developed substantially in accordance with plans and specifications
submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning
Department marked Exhibit Nos. 1 through 8, and as conditioned herein.
2. That prior to final building and zoning inspections or within a period of two (2) years from the date
of this decision, whichever occurs first, Condition No. 1, above-mentioned, shall be complied with.
Extensions for further time to complete said conditions may be granted in accordance with
Section 18.03.090 of the Anaheim Municipal Code.
3. That approval of this application constitutes approval of the proposed request only to the extent
that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or
approval of the request regarding any other applicable ordinance, regulation or requirement.

At the meeting of June 4, 1998, Annika M. Santalahti, Zoning Administrator, considered your
request fora time extension for Variance No. 3879 in order to comply with the conditions of
approval. Ms. Santalahti granted your request to expire on June 4, 1999.
Subsection 18.03.090.0304 provides for one additional extension of time for a reclassification,
conditional use permit, administrative adjustment approved prior to September 1, 1997 when the
limitations on time extension establishing by subsection 18.03.090.0301 have been exceeded.

On June 4, 1998, Annika M. Santalahti, Zoning Administrator, considered your request for a Special
Circumstances Waiver to permit issuance of a Special Events Permit for an existing service station and
convenience market on property located at the southwest comer of Katella Avenue and State College
Boulevard (1801 South State College Boulevard/ARCO am/pm).
She denied Special Circumstances Waiver No. 97-03 under authority of Sections 18.02.055.080 and
18.12.085 of the Anaheim Municipal Code and based on the following findings:
1. That this property is zoned ML (Limited Industrial) and is located in the Stadium Industrial Area.
2. That this request is Categorically Exempt under Section 15061(6)(3) as defined in the CEQA
guidelines, and is exempt from any requirement to prepare further environmental documentation.
3. That approval of a special circumstances waiver to authorize issuance of special events permits in
this industrial area would set an undesirable precedent because special events are not permitted
for any nearby businesses and properties; and that this is one of only two service stations in the
area.
4. That approval of a special circumstances waiver would not serve the public interest and general
.welfare because the Stadium Industrial Area, which includes the Edison International Field of
..Anaheim .and the Arrowhead Pond of Anaheim, is intended to be a high quality business area; and
that recent project approvals in this area have reflected the City's objective of encouraging quality
development and, in light of the large amount of public and private investment being made in this
area; special event activities at this location would be detrimental to the public interest and general
welfare; and that there are no' extraordinary circumstances pertaining to this property to allow this
service. station to conduct special events.
5. That-this property is located at one of the busiest intersections in the City of Anaheim with superior
visibility to passing traffic.
This decision shall become final unless an appeal to the City Council, in writing, accompanied by an
appeal fee, is filed with the City Clerk within ten (10) days from the date of this letter or unless members
of the City Council request review of this decision within said 10 days...

On June 4, 1998, Annika M. Santalahti, Zoning Administrator, considered your request for Special
Circumstances Waiver No. 98-03 to permit issuance of a Special Events Permit for an existing auto
dealership under authority of Code Section 18.12.085 on property located at 1299 South Anaheim
Boulevard (McPeek Dodge). She made the following findings:
1. That a letter requesting this special circumstances waiver and describing the need for the
request was submitted on May 19, 1998 by Frank A. Busalacchi Jr.
2. That this property is zoned ML(Limited Industrial); and that nearby properties zoned
commercially may obtain special events permits without a Special Circumstances Waiver.
3. That approval of special circumstances waivers (allowing modification and/or waiver of
regulations pertaining to special events) is authorized by Subsection 18.02.055.080 "Zoning
Administrator Review (of Special Events Permits)" and Section 18.12.085 "Special Event Permit
- Review" of the Anaheim Municipal Code.
4. That a special events permit at this property will serve the public interest and general welfare by
providing an equitable opportunity to advertise this existing retail commercial business (major
auto dealership) at a major arterial highway intersection in the City of Anaheim.
5. That the construction activities-and temporary closure of Anaheim Boulevard in connection with
the widening of the I-5/Santa Ana Freeway have had an adverse affect on this property and
business.
6. ThaYthe type of advertising proposed for this business will have a negligible affect on the
underlying parking lot and vehicle circulation on the property.
Under authority. of Sections 18.02.055.080 and Section 18.12.085, and as described in the petitioner's
letter dated on May 19, 1998 and the Staff Report dated June 4, 1998, the Zoning Administrator
approved Special Circumstances Waiver No, 98-03 for one (1) to four (4) special events during the one
(1) year period following the date of this letter (June 12, 1998 through June 12, 1999), and that said
special events shall be conducted subject to compliance with the following conditions:
1. That the petitioner shall obtain a Special Events Permit from the Planning Department prior to
conducting the event or not less than fourteen [14] days prior to each event; and

2. .That this outdoor event and the various activities associated with it shall comply with ail the
standards and requirements set forth in Section 18.02.055 Special Event Permit -General of the
Anaheim Municipal Code unless otherwise specifically provided herein, inGuding that the event
shall not be conducted before 7 A.M. nor after 10 P.M., in compliance with Subsection
18.02.055.0606.
This decision shall become final unless an appeal to the City Council, in writing, accompanied by an
