OPPOSITION: No one indicated their presence at the public hearing in opposition and no
correspondence in opposition was received.
REQUEST: Petitionerrequests reinstatement of this conditional use permit to allow sales of
alcoholic beverages for on-premises consumption to continue in an existing
restaurant.
Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced
petition, pursuant to Anaheim Municipal Code. Section 18.12.020, and a public hearing having been duly
noticed for and held on the date set forth above, I do hereby find, pursuant to the Sections
18.02.030.030 through 18.02.030.035 of the Anaheim .Municipal Code:
1. That the use is properly one for which a conditional use permit. is authorized by the Zoning
Code Sections 18.02.030.030 and 18.02.030.035. of the Anaheim Municipal Code;
2. That the use permit, including waiver of the minimum number of parking spaces, was originally
.approved under Decision No. ZA 93=52 and amended under Decision No. ZA 95-4, and granted
several time extensions forthe restaurant to open for business, which ft did about one year ago;
3. That the use permit is being exercised in substantially the same manner and in conformance
with all conditions and stipulations originally approved;
4. That the use, as reinstated, will not adversely affect the adjoining Jand uses and the growth and
development of the area in which it is located;
5. That the use permit is being exercised in a manner not detrimental to the particular area nor to
the surrounding land uses, nor to the public. peace, health, safety and general welfare; and that
since this restaurant has been open, there have been no complaints or Code violations, as noted
in the Staff Report to the Zoning Administrator dated June 2, 1998;
6. That reinstating this conditional use permit, under the conditions imposed, will not be detrimental
to the peace, health, safety and general welfare of the citizens of the City of Anaheim; and
7. That the use is hereby approved for a period of two years, said limitation being a trial period to
determine whether the upgraded alcoholic beverage license (from beer and wine to alcoholic
beverages) will have any adverse impacts on the surrounding neighborhood.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed
the proposal and does hereby find that the Negative Declaration previously approved in connection with
this Conditional Use Permit No. 3633 is adequate to serve as the required environmental documentation
in connection with this request.
Based on the evidence and testimony presented to me, I do hereby approve the request to reinstate
Conditional Use Permit No. 3633, subject to the following:
(a) All the conditions of approval contained in Decision No. ZA 95-04, with the exception of
Condition No. 12 establishing a time limitation, shall remain if full force and effect; and
(b) That Condition No. 12 of said Decision No. ZA 95-04 is hereby amended to read:
"12. That the on-premises sale and consumption of alcoholic beverages (in
addition to beer and wine) in conjunction with meals in an existing
restaurant is granted for a period of two (2) years, to expire on
June 2, 2000."
This decision is made, signed, and entered into the file this ninth day of July 1998.

by an appeal fee, is filed with the City Clerk withtrr 15 davs of the date of the signing of this decision or
unless members of the,City Council shall request to review this decision within said 15 days.
