Waiver of the following to construct a new922,600 sq.ft. building in conjunction with an existing 154,225 sq.ft. building (total 276,825 sq.ft.) on an 11.748-acre parcel in Development Area 1 of the Northeast Area Specific Plan: Sections 18.12.080.020 - Maximum Floor Area (FAR) ratio. and 18.110.050.080.0803 0( 5 FAR permitted; 0.54 proposed) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.12.080: 1. That the maximum permitted development intensity in Development Area 1 "Industrial Area" of the Northeast Area Specific Plan (Specific Plan No. 94-1) is a Floor Area Ratio (FAR) of 0.5. 2. That the proposed FAR is 0.54 (276,825 sq.ft. building floor area /511,742 sq.ft. lot = 0.54). 3. That the request is hereby granted in accordance with Subsection 18.12.080.020 of the Anaheim Municipal Code which permits waiver of percentage requirements which do not deviate more than ten percent (10°!0) from the requirement in connection with administrative adjustments; and that the proposal (a building FAR of 0.54) is 8% greaterthan permitted by Code (0.5 FAR). 4. That no written opposition was received during the required 10-day notification period which ended on August 24, 1998; Based on the evidence presented to me, 1 do hereby determine to grant Administrative Adjustment No. 144, subject to the following conditions: 1. That within a period of one (1) year from the date of this decision, subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No. 1 and 2. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. adj-144.DOC -1 of 2 - ZA 98-24 2. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State - and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
