GRANTING ADMINISTRATIVE ADJUSTMENT NO. 147

REQUEST: Waiver of the following to construct an eight (8) foot high block wall along the
south and east property boundaries:
Sections 18.04.043.100.102 - Maximum fence height inside and rear yards.
18:12.080.015 6 feet permitted in the RM-2400 zone;
and 18.32.064.070 8 feet proposed)
DETERMINATION OF THE ZONING ADMINISTRATOR
Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced
Administrative Adjustment, and subject petition having been duly noticed and no written objections
having been received, I do hereby find, pursuant to Section 18.12.080:
1. That although zoned residentially (RM-2400 "Residential, Multiple Family"), this property is
developed with a legal nonconforming commercial use (an auto repair shop); that the adjoining
land uses are residential; and that the proposed 8-foot high block wall will provide more
effective visual screening between the auto repair shop and adjoining residences.
2. That the request is hereby granted in accordance with Subsection 18.12.080 of the Anaheim
Municipal Code which permits waiver of maximum fence height in side and rear yards in
connection with an administrative adjustment.
3. That no written opposition was received during the required notification period which ended on
November 4, 1998, at 5:00 P.M.
Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No.
147, subject to the following conditions:
That subject property shall be developed substantially in accordance with plans and
specifications submitted to the City of Anaheim by the petitioner and which plans are on file with
the Planning Department marked Exhibit No. 1.
2. That. the appropriate permit for the eight (8) foot high block wall shall be obtained from the
Building Division.
3. That within a period of one (1) year from the date of this decision, Condition Nos. 1 and 2,
above-mentioned, shall be complied with. Extensions for further time to complete this condition
may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code.

4. That approval of this application constitutes approval of the proposed request only to the extent
that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State
:and Federal regulations. Approval does not include any action or findings as to compliance or
approval of the request regarding any other applicable ordinance, regulation or requirement.
This decision is made, signed, and entered into the file this 6th day of November 1998.

NOTICE: This decision shall become final unless an appeal to the City Council, in writing, accompanied
by arr appeal fee, is filed with the City Clerk within 15 days of the date of the signing of this decision or
unless members of the City Council shall request to review this decision within said 15 days.
