OPPOSITION: ` No one indicated theirpresence at the public hearing in opposition and no
correspondence in opposition was received.
REQUEST: Petitioner requests a tentative parcel map fora 2-!ot CL(SC) "Commercial, Limited -
Scenic Corridor" zoned commercial subdivision.
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.12.040, to decidethe above-referenced petition and a public hearing having been duly
noticed for and held on the date set forth above, I do hereby find:
1. That the proposed .map is consistent with the: Anaheim General Plan.
2. That the design and/or improvement of the. proposed subdivision is consistent with General Plan.
3. That the design of the subdivision or the proposed improvements are not likely to cause
substantial environmental damage or substantially and avoidably injure fish. or wildlife or their
habitat.
4. That the design of the subdivision or the type of improvements are not likely to cause serious
public health problems. .
5. That the design of the subdivision or the type of improvements will not conflict with easements,
acquired bythe public at lade, for access hrough or use of the property within the proposed
subdivision.
CALIFORNIA ENVIRONMENTAL QUALITY ACT fINDiNGS: That the Zoning Administrator has
reviewed the proposal fora 2=lot commercial subdivision in the CL(SC) Zone on an irregulariy-shaped
3.5-acre parcel with a frontage of 65 feet on-the north side of Santa Ana Canyon Road, a maximum
depth of 515 feet and being located 922 feet west of the centerline of Weir Canyon Road, and further
described as 8205 East Santa Ana Canyon Road (Pep Boys and vacant property); and does hereby
approve .the Negative Declaration upon finding that she' has considered .the Negative Declaration
togetherwith any comments received during the public review process. and further finding on the basis of
the initial study and any comments received that there is no substantiaF evidence that the project will
have. a significant effect on the environment.

Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative
Parcel Map No. 9&245, subject to the following conditions:
1. That prior to final parcel map approval or grading plan approval, a conceptual drainage report shall
be submitted to the Development Services Division for review and approval, as required by the
City Engineer. The report shall address drainage for the entire site.
2. That prior to final parcel map approval, the developer shall submit a Water Quality Management
Plan (WQMP) specifically identifying the best management practices that will be used on-site to
control predictable pollutants from storm water runoff. The WQMP shall be submitted to the Public
Works Department, Development Services Division, for review and approval in accordance with
Anaheim Municipal Code Chapter 10.09. The WQMP shall be approved prior to approval of the
precise grading plan.
3. That sewer and storm drain improvements within the parcel shall be privately maintained.
4. That the legal owner of the subject property shall irrevocable offer to dedicate to the City of
Anaheim(Water Engineering Division) an easement twenty (20) feet wide for water service mains
and/or an easement for large meters or fire lines. This easement shall be shown on the final
parcel map.
5. That priorto issuance of any building permit, the legal owner of this property shall provide the City
of Anaheim with a public utilities. easement to be determined as the electrical design is completed.
6. That any required relocation of City electrical facilities shall be paid by the developer..
7. That a final parcel map to reconi the division of subject property shall be submitted to and
approved by the City of Anaheim, and shall them be recorded in the Office of the Orange County
Recorder.
8. That an unsuborcfinated-restricted covenant providing reciprocal access and parking, approved by
the City Traffic and Transportation Manager and the Zoning Division and in a form satisfactory to
the City Attorney, shall be recorded with the Office of the Orange County Recorder. A copy of the
recorded covenant shall then. be submitted to the Zoning. Division.. In addition, provisions shall be
made irr the covenant to guarantee that the entire complex{Parcel 1 and 2) shall be managed and
maintained as one (1) integralparcel for purposes of parking, vehicular circulation, signage,
maintenance, land usage and architectural control, and. that the covenant shall be referenced in ail
deeds transfemng all or any. part of the interest in the property.
9. That the legal property owner shall famish a Subdivision Agreement, in a form approved by the
CityAttomey, to the City of Anaheim agreeing to complete the public improvements required as
conditions of this subdivision map at he legal-property owner's expense. Said agreement shall be
submitted to and approved by the City of Anaheim and shalF then be recorded concurrently with the
final parcel map.
10. That approval of this Tentative Parcel Map No. 98-245 is contingent upon approval of and
finalization of Variance No. 4353.
11. That prior to final parcel-map approval, Condition-Nos. 1, 2, 4, 8, 9 and 10, above-mentioned, shall
be complied with.
12. That approval of this application. constitutes approval of the proposed request only to the extent
that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or approval
of the request regarding any other applicable ordinance, regulation or requirement.

NOTICE: This decision shall become final unless an appeal to the City Council, in writing, accompanied
by an appeal fee, is filed with the City Clerk within 10 davs of the date of the signing of this decision or
unless members of the -City Council shall request to review this decision within said 10 days.
DECLARATION OF SERVICE BY MAIL: I do hereby declare under penalty of perjury that on the date
