ZA 99-18 A DECISION OF THE ZONING ADMINISTRATOR APPROVING VARIANCE N0.4359 OWNER: Gary Bukamier 4341 Eureka Avenue, Yorba Linda, CA 92807 LOCATION: 4745 East Bryson Street CEQA STATUS: CEQA NEGATIVE DECLARATION HEARING DATE: May 20, 1999 OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal and no correspondence in opposition was received. REQUEST: Petitioner requests waiver of the following to permit an existing 2,444 sq.ft. office space within an industrial building: Sections 18.06.050.031 - .Minimum number of narking spaces. 18.06.080 24 required; 20 provided) and 18.110.070.110 Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That approval of this parking'waiver is based on information contained in the submitted parking study pertaining to the operational characteristics of the specific use on this property, as concurred with by the City Traffic and Transportation Manager. 2. That the waiver, under the conditions imposed, will not cause fewer off-street parking spaces to be provided for the'underlying use than the number of such spaces necessary to accommodate all vehicles attributable. to such use under the normal and reasonably foreseeable conditions of operation of such use. 3. That the waiver, under the conditions imposed, will. not increase the demand and competition for parking spaces upon the public streets in the immediate vicinity of the underlying use. 4. That the waiver, under the conditions imposed, will not increase the demand and competition for parking spaces upon adjacent private property in the immediate vicinity of the underlying use (which property is not expressly provided as parking for such use under an agreement in compliance with Section 18.06.010.020 of the Zoning Code). 5. That the waiver, under the conditions imposed, will not increase traffic congestion within the off- street parking areas or lots provided for the underlying use.- 6. That the waiver, under the conditions imposed, will not impede vehicular ingress to or egress from adjacent properties upon the public streets in the immediate vicinity of the underlying use. 7. That granting of this parking waiver will not cause an increase. in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses. 8. That granting of thisparking waiver, under the conditions imposed, will not be detrimental to the peace, health, safety or general welfare of the citizens of the City of Anaheim. ZA-V4359.DOC -1 of 2 - ZA 99-18 c ~ ~ CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed this waiver of minimum number of parking spaces to permit an existing 2,444 sq.ft. office space within an industrial building on a irregulariy-shaped 0.45 acre parcel with a frontage of 102 feet on the north side of Bryson Street, a maximum depth of 164 feet, being located 400 feet west of the centerline of Hancock Street, and addressed at 4745 East Bryson Street; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 4359, subject to the following conditions: That building permits shall be obtained from the Building Division for all previously-constructed and un-permitted interior tenant improvement work, and that said improvements shall be completed to the satisfaction of the Building Division. 2. That no required parking area shall be fenced or otherwise enclosed for storage or other outdoor uses. 3. That the amount of floor area used exclusively for office space in the subject building shall be limited to a maximum of two thousand four hundred forty four (2,444) square feet, as shown on the plans submitted by the applicant and approved herein. 4. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 and 2, and as conditioned herein. 5. That within a period of three (3) months from the date of this resolution, Condition Nos. 1 and 4, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 6. That approval of this,application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
