REQUEST: Waiver of the following to construct a 4- to 6-ft. high block wall on the sideyarcf
(facing Maverick Avenue) of a reverse-corner property developed with an
existing single-family residence:
Sections 18.04.043.101 - Maximum fence height.
18.04.043.1021d) (3-foot high fence or wall permitted in side yard along
18.12.080.0151 Maverick Avenue; 4 to 6-foot high wall proposed)

DETERMINATION OF THE ZONING ADMINISTRATOR
Having been appointed Zoning Administrator. by the Planning Director to decide the above-referenced
Administrative Adjustment, and subject petition having been duly. noticed and no written objections
having been received, I do hereby find, pursuant to Section 18.12.080:
1. That the request is hereby granted in accordance with Subsection 18.12.080.0151 of the
Anaheim Municipal Code which permits waiver of maximum fence heights in required yams
in connection with administrative adjustments; and
2. That the proposed fence height waiver pertains to a 4 to 6-foot high block wall in the side
yard (facing Maverick Avenue) of a reverse- comer property developed within asingle-family.
residence; and
3. That written opposition was received during the required 10-day notification period which
ended on June 2, 1999 at 5:00 p.m.; however the person concerned withdrew the letter after
speaking with the applicant and having the request explained.
Based on the evidence presented to me, I do hereby determine to grant Administrative
Adjustment No. 164, subject to the following conditions:
1. That within a period of one (1) year from the date of this decision, subject property shall be
developed substantially in accordance with plans and specifications submitted to the City of
Anaheim by the petitioner and which plans are on filewith the Planning Department marked
Exhibit No. 1. Extensions for further time to complete this condition may be granted in
accordance with Section 128.03.090 of the Anaheim Municipal Code.
2. That approval of this application constitutes approval of the proposed request only to the
extent that it complies with the Anaheim Municipal Zoning Code and any other applicable
City, State and Federal regulations. Approval does not include any other applicable
ordinance, regulation or requirement.

On June 3, 1999, Annika M. Santalahti, Zoning Administrator, considered your request for Special Circumstances
Waiver No. 99-02 to permit issuance of a Special Events Permit to permit nineteen (19) banners mounted on light
poles at an automobile dealership for a period of six (6) months under authority of Code Section 18.12.085 on
property located at 1600 West Lincoln Avenue (Mills Ford). She made the following findings:
1. That a letter requesting this special circumstances waiver and descnbing the need for the request was
submitted on Apri18, 1999 by Joseph Perri.
2. That this property is zoned CH(Commercial, Heavy); and that nearby properties zoned commercially may
obtain special events permits without a Special Circumstances Waiver.
3. That approval of special circumstances waivers (allo•,ving modification and/or waiver of regulations
pertaining to special events) is authorized by Subsection 18.02.055.080 "Zoning Administrator Review (of
Special Events Permits)" and Section 18.12.085 "Special Event Permit -Review" of the Anaheim
Municipal Code.
4. That extraordinary circumstances apply to this property beyond the control of the property owner or
business owner due to CalTrans construction on the Santa Ana (I-5) Freeway on-and off-ramps in the
vicinity of this property. The impacts on Lincoln Avenue in the area where this property is located
include lane closures, traffic congestion, difficult access, and limited visibility to this site.
Under authority of Sections 18.02.055.080 and Section 18.12.085, and as descn"bed in the petitioner's letter dated
on Apri18, 1999 and the Staff Report dated June 3, 1999, the Zoning Administrator approved Special
Circumstances Waiver No. 99-02 for 19 pageantry-style banners attached to the display azea light poles for a
period of six (6) consecutive months (June 14, 1999 through December 14, 1999), and that said special event shall
be conducted subject to compliance with the following conditions:
1. That the petitioner shall obtain a Special Events Permit from the Planning Department prior to
conducting the event or not less than fourteen [I4] days prior to the event; and

2. That this outdoor event (consisting of 19 banners displayed for a period of six months) and the various
activities associated with it shall comply with all the standards and requirements set forth in Section
18.02.055 Special Event Permit -General of the Anaheim Municipal Code unless otherwise specifically
provided herein, in compliance with Subsection 18.02.055.0606.
This decision shall become final unless an appeal to the City Council, in writing, accompanied by an appeal fee, is
filed with the City Clerk within ten (10) days of the date of this letter or unless members of the City Council
request review of this decision within said 10 days.

On June 3, 1999, Annika M. Santalahti, Zoning Administrator, considered your request for Special Circumstances
Waiver No. 99-01 to permit issuance of a Special Events Permit for atone-day auto/bus show (no vehicle sales
proposed) within an existing parking lot at 1501-1551 South Douglass Road in the City of Anaheim, on June 12,
1999. She made the following findings:
L That a letter requesting this special circumstances waiver and describing the need for the request was
submitted on May 14, 1999 by "Moe" Moore, president of the Orange County Transporter Organization
(O.C.T.O.).
2. That this property is zoned ML(Limited Industrial); and that nearby properties zoned commercially may
obtain special events permits without a Special Circumstances Waiver.
3. That approval of special circumstances waivers (allowing modification and/or waiver of regulations
pertaining to spacial events) is authorized by Subsection 18.02.055.080 "Zoning Administrator Review (of
Special Events Permits)" and Section 18.12.085 "Special Event Permit -Review" of the Anaheim
Municipal Code.
4. That extraordinary circumstances are present based on the type of event proposed. This event requires a
large display area due to the number of the vehicles to be displayed, as well as a large area for the parking
of spectator vehicles. This type, of event is not suited to a location in which a spacial event permit is
normally,appmpriatebecauw the impact might be too great on such a normal business location due to tbe
area required.
5. That this event is limited in time and will have a negligible effect on the parking lot and circukation, as
well as the streets and highways in the area which are typically handle an even greater demand when an
event is taking place at the nearby Arrowhead Pond of Anaheim.
6. That this special event will not operate concurrently with any events scheduled at the adjacent Arrowhead
Pond on the same date and time.
7. 'That no flags, banners, or other temporary advertising devices will be utilized which would result in
aesthetic concerns during this event.

Under authority of Sections 18.02.055.080 and Section 18.12.085, and as described in the petitioner's letter dated
on May 14, 1999 and the Staff Report dated June 3, 1999, Item No. 1-A, We Zoning Administrator approved
Special Circumstances Waiver No. 99-01 for the herein described special event to take place on Saturday, June 12,
1999, from 7 a.m. until 12 noon ,and that said special event shall be conducted subject to compliance with the
following conditions:
1. That the petitioner shall obtain a Special Events ~'ermit from the Planning Deparhnent prior to
conducting the event or not less than fourteen [14] days prior to the event; and
2. That this outdoor event (consisting of a one day autoJbus show) and the various activities associated with
it shall comply with all the standards and requirements set forth in Section 18.02.OSS Special Event
Permit -General of the Anaheim Municipal Code unless otherwise specifically provided herein, including
that the event shall not be conducted before 7 A.M nor after 10 P.M., in compliance with Subsection
18.02.055.0606.
This decision shall become final unless an appeal to the City Council, in writing, accompanied by an appeal fee, is
filed with the City Clerk within ten (10) days of the date of this letter or unless members of the City Council
request review of this decision within said IO days.
