ZA 99-21 A DECISION OF THE ZONING ADMINISTRATOR APPROVING TENTATIVE PARCEL MAP NO. 98-248 OWNER: CAFIG, Inc. 5875 Landerbrook Drive, #250 Mayfield Heights, Ohio 44124 AGENT: Juergen Milczewsky 3040 Saturn, Suite 201 Brea, CA 92821 LOCATION: .1001 East Ball Road (the property consists of 10.9 acres located at the northwest comer of Ball Road and East Street) HEARING. DATE: July 1, 1999, continued from the meetings of June 17, June 3, May 20 and May 6, 1999. OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal and no correspondence in opposition was received. REQUEST: To establish a 2-lot industrial subdivision in the ML (Limited, lndustriat) zone. Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for-and held on the date set forth above, I do hereby find: 1. That the proposed subdivision is consistent with the Anaheim General Plan, including the General Industrial land use designation. 2. That the design and/or improvement of the proposed subdivision is consistent with the applicable General Plan. 3. .That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 4. That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. 5. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large for access through or use of the property within the proposed subdivision. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal to establish a 2-lot industrial subdivision in connection with an existing manufacturing and warehouse facility on this 10.9 acre, irregularly-shaped property located at the northwest comer of Ball Raod and East Street, having frontages of 477 feet on the north side of Ball Road and 863 feet on the west side of East Street; and that the Planning Director or his authorized representative has determined that the proposed project is Categorically. Exempt under Class 15, Section 15315 of the State of California Environmental Quality Act Guidelines. Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative Parcel Map No. 98-248, subject to the following conditions: TP98-248.doc -1 of 2 - ZA99-21 • • 1. That prior to approval of a building permit, the developer shall conduct a sewer study specifically identifying the impact any development may have on the public sewer systems serving the property, which systems are known to be deficient. Should the study conclude that the sewer system is unable to accommodate additional flow from further development of the property, the developer shall make the necessary improvements and upgrades to the public sewer system. This requirement shall be evidenced by an improvement certificate on the final parcel map. 2. That prior to recordation of the final parcel map, sidewalks shall be constructed along the street frontages of each parcel on Ball Road and East Street. 3. That a final parcel map to record the division of subject property shall be submitted to and approved by the City of Anaheim, and shall then be recorded in the Office of the Orange County Recorcler. 4. That in connection with any new building construction, trash storage areas shall be provided and maintained in a location acceptable to the Public Works Department, Streets and Sanitation Division, in accordance with approved plans on file with said Department. Said storage areas shall be designed, located and screened so as not to be readily identifiable from adjacent streets or highways. The walls of the storage areas shall be protected from graffiti opportunities by the use of plant materials such as minimum one (1) gallon sized clinging vines planted on maximum three. (3) foot centers, or tall shrubbery. Said information shalt be specifically shown on the plans submitted for building permits. 5. That a plan sheet for solid waste storage and collection and a plan for recycling shall be submitted to the Streets and Sanitation Division for review and approval. 6. That an on-site trash truck tum-around area shall, be provided in accordance with Engineering Standard Detail No. 610 and maintained to the satisfaction of the Streets and Sanitation Division. 7. That prior to final parcel map approval, Condition Nos. 2, 5 and 6, above-mentioned, shall be complied with. 8. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Code and any other applicable City, State, and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
