OPPOSITION: Two interested persons were present at the public hearing; and that no opposition,
either verbal or written, was received regarding the proposal.
REQUEST:. Waivers of the following to establish a 4-lot single-family residential subdivision in the
RS-7200 Zone:
(a) Sections 18.04.020.023 - Minimum width of a residential lot adiacent to an
and 18.12.060.080 arterial hiahway.
120 feet required from Westem Avenue;
72 feet proposed for Parcel No. 1)
(b) Sections 18.12.060.030 - Orientation of a residential lot adiacent to an arterial
and 18.26.065.010 hi hwa .
(single family residential lots shall rear on arterial

Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly
noticed for and field on the date set forth above, (do hereby find:
That-there are special circumstances applicable the property consisting of its location and
surroundings, which do not apply to other identically zoned properties in the vicinity, and that
strict application of the Zoning Code deprives the property of privileges enjoyed by other
:properties tn-identical zoning classification in the vicinity because other single family residential
lots on both sides of Westem Avenue are the same in orientation to similarly lotted
Based on the. evidence and testimony presented to me, I do hereby. determine to approve Variance No.
4373, subject to the following conditions:
1. That a six (6) foot high masonry block wall shalt be constructed and maintained along the west
property line abutting Western Avenue excepting the front setback (measured from Teranimar
Drive) where the wall height shall not exceed three (3) feet; and/or that a bond in an amount and
form satisfactory to the City of Anaheim shall be posted with the City to guarantee the instaNation
of said wall prior to final building inspection. Clinging vines to eliminate graffiti oppodumties shall
be planted on maximum five (5) foot centers adjacent to said wall facing Westem Avenue,

appropriate irrigation,facitities shall be provided, and the landscaping shall be properly maintained
after planting.
2. That the developer shall construct street improvements along Western Avenue and Teranimar
Drive in conformance with the Circulation Element of the Anaheim General Plan and with
Standard Engineering Plans, as approved by the City Engineer. A four (4) foot wide sidewalk shall
be constructed along Teranimar Drive and a five (5) foot wide sidewalk shall be constructed along
Western Avenue. The Sidewalks shall be constructed adjacent to the right-of--way lines.. The
parkway between the curb and sidewalk shall be landscaped and irrigated as approved by the
Urban Forestry Division of the Community Services Department. Anew sidewalk handicapped
access ramp shall be constructed. The existing driveway approach on Western Avenue shall be
removed and replaced with curb, gutter and sidewalk. Street improvements may be shown on the
.grading plan. The plan shall be submitted to the Public Works Department, Development
Services Division, for review and approval. The improvements shall be completed prior to the first
final building and zoning inspection for a building on subject property.
3. That a new sanitary sewer lateral shall be constructed for each house. AN laterals shall connect to
the existing public sewer in Teranimar Drive.
4. That the provisions of City Council Policy No. 542 "Sound Attenuation in Residential Projects' shah
be complied with.
5. That subject property shall be developed substantially in accordance with plans and specifications
submitted to the City of Anaheim by the petitioner and which -plans are on file with the Planning
Department marked Exhibit No. 1, and as conditioned herein.
6. That prior to final building and zoning inspections or within a period of two (2) years from the date
,of this decision, whichever occurs first, Condition Nos. 1, 2, 3, 4 and 5, above-mentioned, shall be
complied with. Extensions for further time to complete said conditions may be granted in
accordance with Section 18.03.090 of the Anaheim Municipal Code.
7. That approval of this application constitutes approval of the proposed request only to the extent
that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action orfindings as to compliance or approval
of the request regarding any other applicable. ordinance, regulation or requirement.
