LOCATION: 470 South Mohler Drive
1.5 acres with a frontage of 206 feet on the east side of Mohler Drive, a
maximum depth of 373 feet, and located 250 feet north of the
centerline of Country Hill Road.
HEARING DATE: July 29, 1999
OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposaland
no correspondence in opposition was received.
REQUEST: To establish a 2-lot single-family residential subdivision in the RS-HS-22,000(SC)
Zone under authority of Code Section 18.12.045.
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly
noticed for and held on the date set forth above, t do hereby find:
1. That the proposed map is consistent with the applicable General Plan.
2. That the design and improvement of the proposed subdivision is consistent with the applicable
General Plan.
3. That the design of this subdivision and the proposed improvements, which are subject to
Mitigation Monitoring Program No. 110, are not likely to cause substantial environmental
damage or substantially and avoidably injure fish or wildlife or their habitat.
4. That the design of this subdivision and the type of improvements are not likely to cause serious
public health problems.
5. That the design of this subdivision and the type of improvements will not conflict with easements,
acquired by the public at large, for access through or use of the property within the proposed
subdivision.
6. That two plans, labeled Exhibit No. 2 (Conceptual Grading Plan, dated July 9, 1999) and Exhibit
No. 2 (Habitat Map overlaid on a Topo Survey, dated ).were submitted in connection with this
tentative parcel map.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has
reviewed the proposal fora tentative parcel map to establish a 2-lot single-family residential subdivision
in the RS-HS-22,000(SC) .(Residential, Single-Family -Scenic Corridor Overlay) Zone on 1.5-acre
irregularly-shaped parcel of land having a frontage of 206 feet on the east side of Mohler Drive, a
maximum depth of 373 feet and being located 250 feet south of the centerline of Country Hill Road, and

further described as 470 South Mohler Drive; and does hereby approve the Mitigated Negative
Declaration upon finding that she has considered the Mitigated .Negative Declaration together with any
comments received during the public review process and further finding on the basis of the initial study
and any comments received that there is no substantial evidence that the project, as developed subject
to Mitigation Monitoring Program No. 110, will have a significant effect on the environment.
Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative
Parcel Map No, 99-123 ,subject to the following conditions:
1. That sewer and storm drain improvements within subject property shall be privately maintained.
2. That both parcels shall be assigned street addresses by the Building Division.
3. That a Signature Omission Letter from the Southern California Edison Company shall be provided
to the City.
4. That areas in which to set out trash barrels for collection shall be provided for each parcel on
Mohler Drive; and that said areas shall be shown on the plans submitted for building permits. All
trash barrels shall be stored out of the public's view."
5. That trash storage .areas shall be provided and maintained in a location acceptable to the Public
Works Department, Streets and Sanitation Division, and in accordance. with approved plans on fife
with said Department. Said information shall be specifically shown on the plans submitted for
building permits.
6. That park in-lieu fees shall be paid the City of Anaheim Community Services Department.
7. That the petitioner shall be responsible .for compliance with all mitigation .measures included in the
attached Mitigation Monitoring Plan No. 110, as established by the City of Anaheim and as
required by Section 21081.6 of the Public Resources Code within the assigned time frames and
any direct cost associated with their implementation.
8. That an unsubordinated covenant shall be recorded with the Office of the Orange County
Recorder requiring the property owner to comply with the mitigation measures indicated in the
Mitigation Monitoring Plan No. 110 and to further provide any future owners of the property with
written information pertaining to these measures for the protection of the Coastal Sage. Scrub on
the property. The covenant shall be submitted to and approved by the City Attorney prior to
recordation; and a copy of the recorded covenant shall be submitted to the Zoning Division.
9. That any specimen tree removal shall be subject to the tree preservation regulations in Section
18.84.038 of the Anaheim Municipal Code pertaining to the "SC" (Scenic Corridor Overlay) Zone.
10. That Mohler Drive shall be improved to conform with the applicable Public Works Department
standards. The requirement for the street improvements shall be included on the-final parcel map
as an improvement certificate. The streetimprovementsshall be constructed and completed prior
to final building and zoning inspections for each home.
11. That prior to final parcel map approval, Condition Nos. 2, 3, 6, 7, 8 and 9, above-mentioned, shall
be complied with.
12. That approval of this application constitutes approval of the proposed .request only to the extent
that it complies with the Anaheim Municipal Zoning Code .and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or
approval of the request regarding any other applicable ordinance, regulation or requirement.
