DETERMINATION OF THE ZONING ADMINISTRATOR
Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced
Administrative Adjustment, and subject petition having been duly noticed and no written objections having
been received, I do hereby find, pursuant to Section 1.8.12.080:
1. That the request is hereby granted in accorldance with Subsection 18.12.080.010.0101 of the
.Anaheim Muniapal .Code which permits waiver of minimum structural setback adjacent to an
arterial highway in connection with an administrative adjustment when the deviation from the
Code requirement does not exceed 20°~.
2. That no written opposition was received during the required 10-day notification period which
ended on December 15, 1999.
Based on the evidence presented #o me, I do hereby determine to grant Administrative Adjustment
No. 185 subject to the following conditions:
1. .That within a period of one (1) year from the date of this decision, subject property shall be
developed substantially in accordance with plans and specifications submitted to the City of
Anaheim by the petitioner and which plans are on file with the Planning Department marked
Exhibit Nos. 1 and 2. Extensions for further time to complete this condition may be granted in
accordance with Section 18.03.090 of the Anaheim Municipal Code.
2. That the appropriate permit(s) shall be obtained from the Building Division.

3. ,That approval of this application constitutes approval of the proposed request only to the extent
that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or
approval of the request regarciing any other applicable orYiinance, regulation or requirement.

Re: Special Circumstances Waiver No. 99-02 -Approved for oneyear until June 14, 2000
On December 30, 1999, Annika M. Santalahti, Zoning Administrator, considered your request for Special
Circumstances Waiver No. 99-02 to retain nineteen (19) pageantry-style banners mounted on light poles in
conjunction with an automobile dealership for an additional period of a six (6) month to expire June 14,
2000. She made the following findings:
1. That this proposal (as described in a letter dated on December 9, 1999 and submitted by
Joseph Perri, General Sales Manager, and in the Staff Report to the Zoning Administrator dated December
30, 1999, and as shown on the submitted exhibits) is for 19 pageantry.-style banners mounted on light poles
in conjunction with an automobile dealership for a period of six (6) months; and that the. property is
developed with an automobile sales facility and is zoned CH (Commercial, Heavy).
2. That extraordinary circumstances still apply to this, property beyond the control of the
property owner or business owner due to Lincoln Avenue road construction and Santa Ana (I-5) Freeway on
and off ramp road construction in the immediate vicinity of this property. The impacts which affect Lincoln
Avenue and Euclid Street in the area in which this property is located include lane closures, traffic
congestion, difficult access, and limited visibility to this site.
3. Special Circumstance Waiver No. 99-02 (to permit 19 banners mounted on light poles at an
automobile dealership for a period of 6 months) was approved by the Zoning Administrator on June 3, 1999,
and expired on December 14, 1999.
4. That approval of a Special Circumstances Waiver (allowing modification and/or waiver of
regulations pertaining to special events) is authorized by Subsection 18.02.055.080 "Zoning Administrator
Review" (of Special Events Permits) and Section 18.12.085 "Special Event Permit -.Review" of the Anaheim
Municipal Code.
5. That this request is for waivers of Code subsections 18.02.055.060.0607 and
18.02.055.060.0608 (maximum nine consecutive days permitted per S.E.P. and a maximum of four S.E.P.'s
permitted per calendar year for a total of 36 days per calendar year; six more months proposed), and
Section 18.02.055.050 (permitted locations and zones; proposed in the ML zone where S. E.P.'s are not
specifically permitted).
Based on the above-findings, Special Circumstances Waiver No. 99-02 is hereby approved for an additional
period of six (6) months until June 14, 2000 subject to the following condition:

1. That the applicant shall maintain all of the banners in good repair and that any wording on the banner
shall be restricted to the name of the dealership and/or the "Ford" logo.
This decision shall become final .unless an appeal to the City Council, in writing, accompanied by an appeal
fee, is filed with the City Clerk within ten (10) days of the date of this letter or unless member of the City
Council requests review of this decision within said 10 days.
