APPROVING TENTATIVE PARCEL MAP NO. 98-242

LOCATION: 7730 Autry Drive. This property consists of 3.0 acres located on the south side of Santa
Ana Canyon Road at the easterly terminus of Autry Drive, approximately 200 feet east of
the centerline of Eucalyptus Drive.
HEARING DATE: March 9, 2000, continued to the meeting of March 23, 2000.
OPPOSITION: A number of concerned persons spoke at the public hearing.
REQUEST: To establish a 4-lot (3 numbered lots and 1 lettered "private access" lot) single-family
residential subdivision in the RS-HS 22,000 (SC)(Residential, Single-Family Hillside -
Scenic Corridor Overlay) Zone for the future construction of three single family homes.
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly
noticed for and held on the date set forth above, I do hereby find:
1. That the proposed map is consistent with the Anaheim General Plan.
2. That the design and/or improvement of the proposed subdivision is consistent with applicable
General Plan.
3. That the design of the subdivision and the proposed improvements are not likely to cause
substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat.
4. That the design of the subdivision and the type of improvements are not likely to cause
serious public health problems.
5. That the proposed 4-lot single-family residential subdivision and its corresponding RS-HS-
22,000 (SC) Zone designation are consistent with the Anaheim General Plan, as discussed in paragraphs
(15) and (17) of the Staff Report to the Zoning Administrator dated March 23, 2000.
6. That the subject site is physically suitable for the type and density of the proposed single-
family residential development.
7. That the design of the subdivision and the improvements are not likely to cause
environmental damage or cause any public health problems, nor will it conflict with any public easements
pertaining to this property.
8. That the proposed density of this subdivision is in conformance with the permitted density
range in the Anaheim General Plan Land Use Element.

9. That the design of the subdivision and the type of improvements will not conflict with
easements, acquired by the public at large, for access through or use of the property within the proposed
subdivision.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has
reviewed the proposal to establish a 4-lot (3 numbered bts and 1 lettered lot) single-family residential
subdivision in the RS-HS 22,000 (SC)(Residential, Single-Family Hillside -Scenic Corridor Overlay) Zone
for the future construction of 3 single family homes on an irregularly-shaped 3.0-acre property having a
frontage of 198 feet on the south side of Santa Ana Canyon Road, a maximum depth of 600 feet, and
being located at the easterly terninus of Autry Drive, approximately 200 feet east of the centerline of
Eucalyptus Drive, and further described as 7730 Autry Drive; and that the Planning Director or his
authorized representative has determined that the proposed project is Categorically Exempt, Class 15,
under Section 15061(b)(3) of the State of California Environmental Quality Ad Guidelines.
Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative
Parcel Map No. 98-242, subject to the following conditions:
1. That the appropriate fees for primary mains shall be paid to the Water Engineering Division in
accordance with the Rules 15A and 20 of the Water Utility Rates, Rules and Regulations.
2. That sewer improvements within the parcel shall be privately maintained and discharged to
Eucalyptus Drive, and that any necessary easements shall be provided.
3. That all conditions of approval of Certificate of Compliance 91-06 shall be complied with.
4. That the Building Division shall assign street addresses to the lots. Street names for any new public
or private street (if requested by the developer or required by the City) shall be submitted to and
approved by the Building Division.
5. That prior to approval of the grading plan, a soils report based on the grading plan shall be
submitted to the Public Words Department, Development Services Division. A final soil report and
certification statement from the responsible engineer shall be submitted prior to final building and
zoning inspection.
6. That prior to approval of a grading plan for each lot or issuance of a building pernit for each lot,
whichever occurs first, any specimen tree removal shall be subject to the tree preservation
regulations in Chapter 18.84 of the Anaheim Municipal Code pertaining to the "SC" Scenic Corridor
Overiay Zone.
7. That prior to approval of grading plans, a drainage report shall be submitted to the Development
Services Division for review and approval. The report shall address drainage for the entire site.
8. That prior to issuance of the first building perrnit for each lot, a detailed noise study based on the
precise site, floor and elevation plans, shall be submitted to the Planning Department for review and
approval by the Zoning Administrator, demonstrating that all reasonable measures have been taken
to meet the requirements of Council Policy No. 542 "Sound Attenuation in Residential Projects".
The decision reached by the Zoning Administrator may be appealed to the City Council.
9. That prior to approval of a grading plan for each lot or issuance of a building permit for each lot,
whichever occurs first, final specific site, floor and elevation plans shall be submitted to the Zoning
Division for Zoning Administrator review and approval.
10. That Final Parcel Map No. 98-242 shall be submitted to the Public Works Department,
Development Services Division, for review and approval, and then shall then be recorded in the
office of the Orange County Recorcier.

11. That the legal property owner shall irrevocably offer to dedicate to the City of Anaheim an easement
across the property (to be determined when electrical design has been completed) for public utility
purposes.
12. That any required relocation of dty electrical fadlities shall be at the expense of the developer.
13. That an unsubordinated maintenance covenant shall be submitted to the Subdivision Section
(Development Services Division of the Public Works Department) and reviewed and approved by
the City Attorney's office. The covenant shall include provisions for the maintenance of private
facilities in this parcel map, inducting Lot A, and a maintenance exhibit and shall provide for the
following:
(a) The maintenance covenant shall provide that if an agreement is adopted for the shared
maintenance of Autry Drive (a private street) by properties which may use Autry Drive for
access to Eucalyptus Drive, then the parcels in this map shall be responsible for their fair
share of the cost to maintain Autry Drive; and
(b) The maintenance covenant shall provide that if an agreement or covenant is adopted for the
shared maintenance of Dorothy Lane (a private street) by properties which may use Dorothy
Lane for access to Eucalyptus Drive, then the parcels in this map shall be responsible for
their fair share of the cost to maintain Dorothy Lane.
The subject property shall be maintained in compliance with the provisions of the covenants and/or
agreements.
14. That prior to final parcel map approval, Condition Nos. 1, 3, 4, 11 and 13, above-mentioned, shall
be complied with.
15. That approval of this application constitutes approval of the proposed request only to the extent that
it complies with the Anaheim Munidpal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or approval
of the request regarrJing any other applicable ordinance, regulation or requirement.

I have been appointed Zoning Administrator by the Planning Director to decide the
above-referenced Administrative Adjustment; however, since written objection(s) were received
during the ten-day public notice period ending on April 5, 2000 I am no longer authorized to act on
this proposal unless a public hearing is first conducted, as specified by Anaheim Municipal Code
Section 18.12.080.
A public hearing will be scheduled after you have submitted the appropriate information and have
paid the cost of notification for such hearing. Please contact one of the zoning representatives in the
Planning Department for further assistance.
If you choose not to proceed with Administrative Adjustment No. 188, no further action is
necessary.
