This property is an irregularly-shaped parcel consisting of about 7 acres located
about 331 feet south of Rio Grande Drive, west of Fairmont Boulevard and east
of Canyon Woods Drive.
CEQA STATUS: Categorical Exemption, Section 15061(b)(3)

REQUEST: Waiver of tl"ie following to construct 6-foot high wrought iron fencing in the front
yard setbacks along Heath Terrace (a new private street) of a new 6-lot single-
family residential subdivision in the RS-HS 22,000(SC) (Residential, Single
Family Hillside -Scenic Corridor Overlay) Zone:
Sections 18.04.043.100.0101(a) - Maximum fence height.
18.12.080.015 (3 feet permitted in required 16 to 19-foot
18.23.063.010.011 front setbacks;
and 18.23.064.070 6 feet high with minimum 6-foot setbacks
proposed on four lots)
DETERMINATION OF THE ZONING ADMINISTRATOR
Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced
Administrative Adjustment, and subject petition having been duly noticed and no written objections having
been received, I do hereby find, pursuant to Section 18.12.080:
1. That this proposal, which consists of wrought iron fencing, was originally advertised as tubular
steel; and that the appearance of wrought iron is comparable to tubular steel.
2. That the proposed fencing will enclose large side yards which are wider than 49 feet and provide
outdoor recreational space for each home; that the fencing will not be placed in the front setback
areas between the houses and Heath Terrace; and that the fencing will not obstruct any lines-of-
sight because none of the driveways to Heath Terrace will be located close to the fencing (i.e., all
the driveways will be located more than 30 feet away from the fencing).
3. That the Final Map of the underlying Tract Map No. 15837 (to establish a 6-dwelling single family
residential subdivision) was approved on March 28, 2000.
4. That this request is hereby granted in accordance with Subsection 18.12.080.015 of the Anaheim
Municipal Code which permits waiver of maximum permitted fence height in connection with an
administrative adjustment.
5. That no written opposition to this proposal was received during the required 10-day notification
period which ended on May 1, 2000.

Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No.
2000-00189, subject to the following conditions:
That within a period of two (2) years from the date of this decision, subject property shall be
developed substantially in accordance with plans and specifications submitted to the City of
Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit
No. 1. Extensions for further time to complete this condition may be granted in accordance with
Section 18.03.090 of the Anaheim Municipal Code.
That approval of this application constitutes approval of the proposed request only to the extent that
it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or approval
of the request regarding any other applicable ordinance, regulation or requirement.
This decision is made, signed, and entered into the file this 11'h day of May, 2000.

NOTICE: This decision shall become final unless an appeal to the City Council, in writing, accompanied
by an appeal fee, is filed with the City Clerk within 15 days of the date of the signing of this decision or
unless members of the City Council shall request to review this decision within said 15 days.
