DETERMINATION OF THE ZONING ADMINISTRATOR
Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced
Administrative Adjustment, and subject petition having been duly noticed and no written objections having
been received, I do hereby find, pursuant to Section 18.12.080:
1. That the request is hereby granted in accordance with Subsection 18.12.080. of the
Anaheim Municipal Code which permits waiver of maximum fence and gates in connection with an
administrative adjustment.
2. That no written opposition was received during the required 10-day notification period
which ended on Monday, May 15, 2000.
Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment
No.2000-00194, subject to the following conditions:
1. That within a period of one (1) year from the date of this decision, subject property shall be
developed substantially in accordance with plans and specifications submitted to the City of
Anaheim by the petitioner and which plans are on file with the Planning Department marked
Exhibit Nos. 1, 2 and 3. Extensions for further time to complete this condition may be granted in
accordance with Section 18.03.090 of the Anaheim Municipal Code.

2. That approval of this application constitutes approval of the proposed request only to the extent
that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or
approval of the request regarding any other applicable ordinance, regulation or requirement.
This decision is made, signed, and entered into the file this 25th day of May, 2000.

Re: Special Circumstances Waiver No. 2000-03 -Approved
On June 1, 2000 Annika M. Santalahti, Zoning Administrator, considered your request for Special
Circumstances Waiver No. 2000-032 to permit issuance of a Special Event Permit for an automobile
dealership in the ML (Limited Industrial) Zone to allow one month-long tent sale at 1200 South Anaheim
Boulevard during the calendar year 2000. She made the following findings:
1. That Special Event Permits are permitted in industrial zones in conjunction with any use
for which a conditional use permit has been issued authorizing a use which is permitted as a matter of
right in any commercial zone; and that approval of a Special Circumstances Waiver to allow modification
and/or waiver of the regulations pertaining to special events is authorized by Subsection 18.02.055.080
"Zoning Administrator Review (of Special Event Permits)" and Section 18.12.085 "Special Event Permit -
Review" of the Anaheim Municipal Code.
2. That the subject property is developed with an automobile dealership (McPeek Dodge of
Anaheim) in the Limited Industrial (ML) Zone; and that said use is a not permitted by right in any
commercial zone and, therefore, an application for a Special Circumstances Waiver was submitted on
May 16, 2000 by Frank Busalacchi Jr., Executive Vice President of McPeek's Dodge of Anaheim, Inc.
3. That the proposed special event is a promotional sale which includes a 15' x 60' tent,
overhead pennant strings, and non-metallic balloons on vehicles; and that the duration of the event is
from May 31 through July 4, 2000.
4. That nearby properties zoned are commercially and may obtain special event permits
without a special circumstances waiver.
5. That a special event permit at this location will serve the public interest and general
welfare by providing an equitable opportunity to advertise the existing retail commercial business (a major
automotive dealership) located in an industrial zone at a major arterial highway intersection.
Under authority of Sections 18.02.055.080 and Section 18.12.085, and as described in the petitioner's
letter dated May 16, 2000 and the Staff Report dated June 1, 2000, the Zoning Administrator approved
Special Circumstances Waiver No. 2000-03, subject to compliance with the following conditions:
That this event shall be limited to the period of May 31, 2000 through July 4, 2000.
That any permits required for the tent or other temporary improvements shall be obtained from
the City of Anaheim.

3. That the applicant shall apply for and obtain Special Event Permits for this event from the
Planning Department in the manner specified in subsection 18.02.055.060.0607 of the Anaheim
Municipal Code (i.e., no permit shall be issued for a period in excess of nine (9) consecutive
days).
4. That this outdoor event and the various activities associated with it shall comply with all the
standards and requirements set forth in Section 18.02.055 Special Event Permit -General of the
Anaheim Municipal Code unless otherwise specifically provided herein, including that the event
shall not be conducted before 7 A.M. nor after 10 P.M., in compliance with Subsection
18.02.055.0606.
This decision shall become final unless an appeal to the City Council, in writing, accompanied by an
appeal fee, is filed with the City Clerk within ten (10) days from the date of this letter or unless members
of the City Council request review of this decision within said 10 days.
