DETERMINATION OF THE ZONING ADMINISTRATOR
Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced
Administrative Adjustment, and subject petition having been duly noticed and no written objections having
been received, I do hereby find, pursuant to Section 18.12.080:
That the proposed addition to the existing one-story 3-bedroom dwelling is a family room.
2. That the request is hereby granted in accordance with Subsection 18.12.080.020 of the
Anaheim Municipal Code which permits waiver of maximum lot coverage in connection with administrative
adjustments if the deviation does not exceed 10% of the Zoning Code requirement; and that the
proposed coverage (1,925 sq.ft.) is 10% (174 sq.ft.) larger than permitted by Code (1,750 sq.ft.).
3. That no written opposition regarding the proposed waiver of maximum lot coverage (35%
permitted, 38.5% proposed) for aone-story rear addition in conjunction with an existing single-family
dwelling was received during the required 10-day notification period which ended on Tuesday, November
14, 2000 at 5:00 P.M.
Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No.
2000-00203, subject to the following conditions:
That the subject property shall be developed substantially in accordance with plans and
specifications submitted to the City of Anaheim by the petitioner and which plans are on file with
the Planning Department marked Exhibit No. 1.
2. That within a period of one (1 }year from the date of this decision, the applicant shall obtain the
appropriate building permits for the addition from the city. Extensions for further time to complete
this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal
Code.

3. That approval of this application constitutes approval of the proposed request only to the extent
that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or
approval of the request regarding any other applicable ordinance, regulation or requirement.
This decision is made, signed, and entered into the file this 20th day of November, 2000.

Following is an excerpt from the minutes of the Zoning Administrator meeting of November 16, 2000.

LOCATION: 1190 North Van Norne Way: The property is 0.51 acre located at the southeast corner
of Coronado Street and Van Horne Way, having frontages of 125 feet on the south side of
Coronado Street and 179 feet on the east side of Van Horne Way.
Three-month status report specified by Condition No. 15 of Decision No. ZA 2000-30, signed on August
17, 2000 to approve Variance No. 4402.
Following public input, Ms. Santalahti, Zoning Administrator, noted the recommendation in the Staff Report is
due to a certain amount of non-compliance during the past 3 months and that perhaps proceedings for
modification or revocation of this Variance should be initiated. Ms. Santalahti asked whether staff, based on
what they have heard at this meeting, have a different recommendation or added information that might be
helpful. Mr. Kevin Bass, Associate Planner, stated the remaining conditions are to be satisfied within the
next 3 months; the problem is that given the history of over a year's worth of trying to resolve issues through
Code Enforcement action and if all the conditions are not satisfied within the overall 6 months specified in the
Decision, Staff wants to have a mechanism in place to consider modification or revocation of this Variance.
A public hearing is required to modify conditions of approval, and because of the case history, Staff wants to
be ready for possible modification, including termination, of the Variance. Ms. Santalahti stated the 6 month
date is February 17, 2001, and the decision to set a public hearing would be made latest at a meeting in
January 2001. Mr. Bass stated there are two choices: to consider a modification as soon as possible or, if
the Zoning Administrator wishes, delay initiation of a public hearing to a date when the Variance can be
considered for modification at the same time as the conditions are reviewed for compliance. Staff will notify
everyone involved of that meeting date and prepare a Staff Report.

ACTION: Ms. Santalahti continued this item to the Zoning Administrator meeting of December 28, 2000 to
determine whether any further progress has been made, including whether the issues with the noise
equipment have been worked out and Mr. Malkoff has a better idea as to timing, for the purpose of
determining whether a public hearing should be scheduled. Ms. Santalahti said that if Staff hasn't received
adequate and/or satisfactory information within the next month and half, a public hearing may be scheduled
at that time; that interested persons will be notified of the meeting; that a "Reports and Recommendations"
Staff Report will be prepared, including whether or not a hearing should be scheduled. Ms. Santalahti
reminded Staff to make sure that Mr. First is sent a letter reminding him of the December 28th meeting and
also recommended to Mr. First that he continue to let Code Enforcement know if there is deviation from the
conditions of approval.
