OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal and
no correspondence in opposition was received.
REQUEST: Petitioner requests waiver of the following to construct an addition to an existing two-story
single family residence in the RS-HS-10,000(SC) (Residential, Single-Family Hillside -Scenic Corridor
Overlay) Zone:
Sections 18.12.050.020 - Minimum side yard setback.
and 18.24.063.020 6 feet required, 3 feet proposed for the west side yard;
15 feet for the combined side yards of two-story dwelling required, 14 feet
proposed)
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly
noticed for and held on the date set forth above, I do hereby find:
1. That the petitioner submitted revised plans increasing the proposed setback to 3 feet,
(instead of 2 feet as originally proposed).
2. That there are special circumstances applicable to this property consisting of its
configuration and topography, which do not apply to other identically zoned properties in the vicinity,
because this property is irregularly-shaped and adjoins a steep downward slope on the west property line
where the setback waiver is proposed; and since the width of the adjacent slope is more 40 feet from
top-of-slope to toe-of-slope, the neighboring dwelling is significantly further away from the proposed two-
story addition than the minimum 9-foot distance required between dwellings when one or both dwellings
are 2-stories.
3. That the west side and street view of the proposed addition, including the roof and eave
configuration, are designed to blend with the existing architecture of the dwelling and include two
fireplaces and windows on the west-facing wall.
Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No.
2001-04425, subject to the following conditions:
1. That the appropriate permits shall be obtained from the Building Division; and that the proposal
shall comply with all applicable City standards including the minimum setbacks between property
lines and permitted encroachments such as roof eaves and fireplaces.

2. That subject property shall be developed substantially in accordance with plans and specifications
submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning
Department marked Revision No. 1 of Exhibit Nos. 1 and 2, and as conditioned herein.
3. That prior to issuance of a building permit or within a period of one (1) year from the date of this
decision, whichever occurs first, Condition No. 1, above mentioned, shall be complied with.
Extensions for further time to complete said conditions may be granted in accordance with Section
18.03.090 of the Anaheim Municipal Code.
4. That approval of this application constitutes approval of the proposed request only to the extent
that it complies with the Anaheim Municipal Code and any other applicable City, State and Federal
regulations. Approval does not include any action or findings as to compliance or approval of the
request regarding any other applicable ordinance, regulation or requirement.
This decision is made, signed, and entered into the file this 9th day of April 2001.

At the meeting of April 5, 2001, Annika M. Santalahti, Zoning Administrator, considered your request for a
retroactive time extension for Tentative Parcel Map No. 98-245 to establish a 2-lot commercial subdivision at
8205 East Santa Ana Canyon Road. This tentative map was approved on March 18, 1999 in conjunction
with Variance No. 4353 and expired on March 18, 2001 under Section 17.08.110 "Expiration of Tentative
Map Approval° of the Anaheim Municipal Code.
ACTION: Ms. Santalahti determined that the Negative Declaration previously approved in connection with
Variance No. 4353 and Tentative Parcel Map No. 98-245 is adequate to serve as the required environmental
documentation in connection with this request upon finding that the deGaration reflects the independent
judgment of the lead agency and that it has considered the previously approved Negative DeGaration
together with any comments received during the public review process and further finding on the basis of the
initial study and any comments received that there is no substantial evidence that the project will have a
significant effect on the environment.
Ms. Santalahti granted the time extension, retroactive from March 18, 2001, to expire on March 18, 2002.
This decision shall become final unless an appeal to the City Council, in writing, accompanied by an appeal
fee, is filed with the City Clerk within ten (10) days from the date of this letter or unless members of the City
Council request review of this decision within said 10 days.

Re: Special Circumstances Waiver No. 2001-12 - A~aroved
On April 5, 2001 Annika M. Santalahti, Zoning Administrator, considered your request for Special
Circumstances Waiver No. 2001-12 to permit a Special Evert Permit for aone-day special event
consisting of an automobile show at 1501-1551 South Douglass Road. She made the following findings:
1. That a letter requesting this special circumstances waiver and describing the proposal
was submitted on March 1, 2001 by Susan Lundgren, Orange County Transportation Organization.
2. That approval of special circumstances waivers (allowing modification and/or waiver of
regulations pertaining to special events) is authorized by Subsection 18.02.055.080 "Zoning Administrator
Review (of Special Events Permits)" and Section 18.12.085 "Special Event Permit -Review" of the
Anaheim Municipal Code.
3. That the property is zoned ML (Limited Industrial); that the Anaheim General Plan land
use designation is Business Office/Mixed Use/Industrial; and that the underlying parking lot was
established in connection with Conditional Use Permit No. 3700.
4. That this specific request is for waiver of Subsection 18.02.055.050(c) which allows
special event permits in any zone in conjunction with a use for which a conditional use permit has been
issued authorizing said use which is permitted as a matter of right in any commercial zone; but that a
parking lot is not a permitted np •marv use in any commercial zone and, therefore, this special
circumstances waiver was submitted.
5. That approval of this special circumstances waiver serves the public interest and general
welfare, as discussed in the Staff Report to the Zoning Administrator, dated April 5, 2001.
Under authority of Sections 18.02.055.080 and Section 18.12.085, and as described in the petitioner's
letter and in the staff report, the Zoning Administrator approved Special Circumstances Waiver No. 2000-
12for the herein described special event on Saturday, June 9, 2001, subject to compliance with the
following conditions:
1. That prior to (or not less than fourteen [14] days prior to) the event, the petitioner shall obtain a
Special Event Permit from the Planning Department.
2. That this outdoor event and the various activities associated with it shall comply with all the
standards and requirements set forth in Section 18.02.055 "Specal Event Permit -General" of the
Anaheim Municipal Code unless otherwise specifically provided herein, inGuding that the event shall
not be conducted before 7 A.M. nor after 10 P.M., in compliance with Subsection
18.02.055.060.0606.
