REQUEST: Petitioner requests waivers of the following to establish a 2-lot single family residential
subdivision and to demolish a garage in con}unction with an existing single-family
residence in the RS-A-43,000 (ResidentiaVAgricultural) Zone:
(a) Sections 18.12.060:080 .. -. Minimum lot width.
and 18.21.061.020 (140 feet required; 126 feet proposed for Parcel 1)
(b} Sections 18.06.050.010.011 - Minimum number type and design of off-street aarkin4 spaces.
18.12.060.010 (4 off-street spaces including at least 2 garaae spaces required;
18.12.060.110. for Parcel 1; no _garage spaces proposed on Parcel 1 because
and 18.21.066.010 the existing garage is proposed to demolished and not replaced)
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section '! 8.12.040, to decide the above-referenced petition and a public hearing having been duly
noticed for and held on the date set forth above, I do hereby find:
1. That waiver (a), minimum tot width, is hereby approved on the basis that there are special
circumstances applicable to the property consisting of the size and depth of the proposed Parcel 1
(1.1 acres and 378 feet deep) in the context of ifs locatiori and surroundings, which do not apply to other
single-family residentially zoned properties in the vicinity. (which adjoin Parcel 1 on the north); and that the,
proposed. lot line between Parcels 1 and 2 would appropriately separate the existing disparate residential
use (on proposed Parcel 1) and the electrical transmission lines and nursery uses (on proposed Parcel.2).
2. That waiver (b), minimum number, type, and design ofoff-street parking. spaces, is
proposed because the property line separating proposed Parcels 1 and 2 is the same as the northerly
edge of the existing utility line easement.
3. That waiver (b) is hereby denied on the basis that proposed Parcel 1 is large enough to
accommodate a new 2-car garage and that there are no spec'sal circumstances applicable to the property
such as size, shape, topography and/or location to justify the requested parking space waiver; that this
decision is conditioned upon either the existing dwelling on proposed Parcel 1 being demolished or, if the
dwelling is retained; a new 2-car garage being constructed in compliance with the applicable city codes
(including obtaining a building permit) within a period of one year from the.date of the final map being
approved; and that a bond shall be posted prior.to`approval of a final parse( map t0 guarantee Compliance
with this condition::

4. That strict application of the Zoning Code deprives the property of privileges enjoyed by
other properties in identical zonirig.classification in the vicinity.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS:.That the Zoning Administrator has reviewed
the proposal for waivers of minimum lot width and minimum number, type and design of off-street parking
spaces to establish a 2-lot.single family residenfial subdivision and to demolish a garage in conjunction
with an existing single-family residence in the RS=A-43,000 (ResidentiallAgriculturai) Zone on irregularty-
shaped 6.2-acre. property having a froritage of 301. feet on the west side of Euclid Street and a maximum
depth of 1,271 feet, being located 220 feet south of the centerline of Cris Avenue, and further described
as 1619 South Euclid Street (existing single-family dwelling) and 1631 South Euclid Street (Southern
.California Edison easement);. and does hereby approve the Negative Declaration upon finding that she
has considered the Negative Declaration together with any comments received during the public review
process and further finding on the basis of the initial study and any comments received that there is no
substantial evidence that the project will have a significant effect on the environment.
Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No.
2001-04475, in'part, subject to the following conditions:
1. That subject property shall be developed substantially in accordance with plans and specifications
submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning
Department marked Exhibit No. 1, and as conditioned herein.
2. That the legal property owner shalt post a band with the City of Anaheim, in a form and amount
satisfactory to the Building Division and the City Attorney, to guarantee either (a) the construction of a
new two (2) car garage on Parcel 1 in compliance with all applicable city codes including obtaining a
building permit, or (b) the demolition of the existing single-family dwelling on Parcel 1 in compliance
with all applicable city codes including obtaining the appropriate permits; and that said improvement
(i.e., either construction of a new garage or demolition of the existing dwelling) shall.be completed
within a period of one (1) year from the date the final parcel map is approved by the City of Anaheim
and recorded with the Office of the Orange County Recorder; and, further, that the value of the bond
shat{ take into account the fact that under current codes, a final map shall be recorded within a period
of two (2) years from the date the tentative map is approved unless time extensions- are approved,
and that a maximum of three (3), one (1) year, time extensions may be granted in connection with a
tentative map (which means that it may take up to five (5) years before a new 2-car garage is
constructed or the existing dwelling is demolished). A copy of said bond shall be flied with this
Variance No. 2001-04475.
3. That approval of this application constitutes approval of the proposed request only to the extent that it
complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal
regulations. Approval does not include any action or findings as to compliance or approval of the
request regarding any other applicable ordnance, regulation or requirement.
4. That the legal property owner shall obtain the appropriate demolition and any other necessary
permits from the City of Anaheim for the demolition of any structures which are proposed to be
demolished, including the existing 2-car garage on Parcel 1, to ensure that no existing structures
cross-over the new property fine between Parcels 1 and 2, or otherwise violate existing city codes;
and that demolition of the existing 2-car garage (and any other structures planned for demolition)
shall be completed prior to approval of the final map.
5. That prior to approval of a final map in connection with Tentative Parcel Map.No. 2001-195 or within
a period of one (1) year from the date of this decision, whichever occurs first, Condition Nos. 1, 2
and 4, above-mentioned, shall be complied with. > Extensions for further time to complete said
conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code.
