No one indicated their presence at the public hearing in opposition to the proposal and no correspondence in opposition was received. REQUEST: Sections 18.04.043.100.101(a1 . - Maximum fence hei ht within the required front 18.12.060.090 yard setback. 18.26.063:010 (3-foot high wall permitted in front 22-foot setback and 18.26.064.110 of a lot in the RS-7200(SC) zone; 6-foot high wall proposed at 0 to 7-foot setback from Camino Tampico) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date. sefif6rth above, I do hereby find: 1. That this variance is hereby approved, in part, permitting the proposed 6-foot high wall at a setback ranging from 4 feet to 7 feet (west to east) from Camino Tampico (instead of 0 to 7 feet, as was proposed); that the waiver is approved, in part, on the basis that there are special circumstances that affect this property. due to its odd shape; that the lot is unusually shaped (trapezoidal) compared to other lots (rectangular) in the vicinity and the lot frontage is much wider than the lot is deep; that the width is 169 feet (minimum 70 feet required by Code) and the depth ranges from 91 feet along the westerly side to 20 feet along the easterly side (minimum 103 feet required by Code); and that strict application of the Zoning Code deprives the properly of privileges enjoyed by other properties for establishing screened private recreatianAeisdre areas vuithin the back and side yards. 2. That the City Traffic and Transportation Manager has reviewed the site plan, as approved, and determined that the proposed wall, located at a minimum 4-foot setback from Camino .Tampico near the west property line, will not interfere with necessary lines-of-sight between subject property and the abutting single-family residence to the west. 3. That, as approved, a 4 to 7-foot deep landscaped setback will be maintained along Camino Tampico and will create a single landscaped area for uniform maintenance and will encourage the growth of plant materials to reduce the mass of the block wall and prevent graffiti opportunities. Based on the evidence and testimony presented to me, t do hereby determine to approve Variance No. 2001-04478, in part, subject to the following conditions: V200.1-04478.doc -1 of 2 - ZA 20.02-07 z, ._ 1. (a) That the approyed.block wall sha0.maintain a minimum four (4) to seven (7) foot front setback along Camino Tampico, as shown on the approved plans; (b) That landscaping; including cliriging'vines and shrubs, shall be planted adjacent to the wall facing the public street in order to prevent graffiti opportunities; and (c) That a landscaping plan shalt be submitted to the Zoning .Division showing the specific plants, sizes arid locations in the setback area between the approved wall and. the street. 2. That the subject property shall be.developed substantially in accordance with plans and specifications submitted to the City of Anaheim by tfie:petitioner and which plans are on file with the Planning Department marked Revision No, 1 of Exhibit Nos. 4 and 2, and as conditioned herein. 3. That within a period of orie (1) year from the date of this decision, Condition Nos. 1, 2 and 5, herein-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section,18.03.090 of the Anaheim Municipal Code. 4: That approval of this application constitutes approval of the proposed request only to the extent that it complies.with the Anaheim Municipal Zoning Code and any.other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any. other applicable ordinance, regulation or requirement. 5. That the appropriate permit shall be obtained from the Building Division for the proposed six (6) foot high wall.
