REQUEST: Petitioner requests the following waiver to expand a living roam, kitchen and bedroom, grid to add a new bathroom to a single family residence in the RS-7200 Residential, Single-Family Residential) Zone: Sections 18.12.060.050 " - Minimum front vard setback. and 18.26:063.010 25 feet required along Bellevue Drive (east :west); 13 feet proposed) Having. been•appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly ;noticed for and held on the date set forth above,) do hereby find:. 1. That the waiver is hereby approved on the basis that there are special circumstances applicable. to the property consisting of its shape and location, which do not apply to other identically zoned properties in the vicinity; .and that strict appiica#ion of the Zoning Code would deprive the property of privileges enjoyed by other properties under Identical zoning classification in the vicinity. 2. That although sub}ecf property is located on a comer, it is not at the intersection of iwa separate streets;. Bellevue Drive is a `knuckle' configuration and, therefore, the lot~has an exceptionally long frontage along Bellevue Drive (174 feet) in comparison to other residential lots in the area (70 feet). 3. That the existing and proposed street setbacks for this lot are 21 to 63 feet along the north- south portion of Bellevue Drive, and 13 to 34 feet along the east west portion of Bellevue Drive; that the resulting street setback areas total more than 3,100 sq.ft., or 39% of the. total lot area (7,840 sq.ft.), which is significantly Larger than a typical front yard in the R5 7200 zone (25% of the lot area): 4. That the proposed setback is compatible with the neighboring property to the east which has a similar setback on Bellevue Drive. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal for waiver of minimum front yard setback to expand a living room, kitchen and bedroom, and to. add a new bathroom to a single family residence in the RS-7200 (Residential, Single-Family Residential) Zone an a 0.18-acre lot located at the northeast corner of Bellevue Drive (east-west) and Bellevue Drive (north-south), having frontages of 113 feet on the north side of Bellevue Drive (east west) V2002-04510.doc -1 of 2 - ZA2002-21 corrected 07-08-02 r and 61 feet on the east side of Bellevuee Drive {north=sout(ij; and further described as 833 West Bellevue Drive; and that the Planning Director or his authorized representative has determined that the proposed project is Categorically. Exempt (Class 1) under Section 15061 of the State of California Environmental Quality Act Guidelines. Based on the evidence and testimony presented to me, l do hereby determine to approve Variance No. 20.02-04510, subject to the following conditions: 1. That the subject property shall be developed substantially in accordance with the plan and specifications submitted to the City of Anaheim by the petitioner and which plan is on file with the Planning Department marked.Exhibit No. 1. 2. That within. a period.of one (1) year from the date of this decision, the petitioner shall obtain the appropriate permits from the Building Division. Extensions for further time may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 3.. .That approval of this appiicatron constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable~City; State and Federal regulations.
