HEARING DATE: August 19, 2004, continued from the August 5, 2004 meeting
OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal and
no correspondence was received in opposition.
REQUEST: Waiver of the following to construct a room addition and garage expansion to the rear of
an existing single family residence in the RS-2 (Residential, Single-Family) Zone:
Sections 18.04.100.010.0101 - Minimum rear yard setback.
and 18.74.040.020.0205 10 feet permitted when equal usable open space is
available elsewhere on the lot;

Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.74.040 .(Approval Authority), to decide the above-referenced petition and a public hearing
having been duly noticed for and held on the date set forth above, I do hereby find:
1. That subject property is a corner lot having frontages on two streets with a 25-foot setback
along the `front' street (Columbine Place) and a 13-foot 5-inch setback along the `side' street (Coronet
Avenue); that the proposed addition will not have an adverse impact on neighboring properties because
the addition is single story and will be located between the existing garage and residence; and that the
available open space in the back yard exceeds the requirement, including after the proposed addition is
completed.
2. That strict application of the Zoning Code would deprive this property of privileges enjoyed
by other surrounding RS-2 zoned properties in the neighborhood which have similar additions, as
identified in paragraph (11) of the Staff Report to the Zoning Administrator dated August 19, 2004; and
that most of the homes in the vicinity of the subject property have attached garages located close to the
adjoining streets.
3. That the 4-foot, 10-inch setback between the existing detached garage and rear property
line is an existing condition; and that complying with Code would require relocating the garage thereby
impacting the usable yard area to the rear of this residence.
Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No.
2004-04617, subject to the following conditions:
1. That subject property shall be developed substantially in accordance with plans and specifications
submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning
Department marked Exhibit Nos. 1, 2 and 3.

2. That within a period of one (1) year from the date of this Decision, the appropriate permits shall be
obtained from the Building Division. Extensions for further time to complete this condition may be
granted in accordance with Section 18.60.170 (Extension. of Time to Comply with Conditions of
Approval) of the Anaheim Municipal Code.
That approval of this application constitutes approval of the proposed request only to the extent that
it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or approval
of the request regarding any other applicable ordinance, regulation or requirement.

NOTICE: This Decision shall became final unless an appeal to the City Council, in writing, accompanied
by an appeal fee, is filed with the City Clerk within 15 days of the date of the signing of this decision or
unless members of the City Council shall request to review this decision within said 15 days.
